WE RESPECTFULLY OBJECT TO BILL 79, AND REQUEST THAT THE COUNCIL VOTE AGAINST PASSING BILL 79. Our objection to Bill 79 is based on the following: 1. There is no clear or rational nexus for the proposed parking requirements contained within the Bill. A nexus study must be prepared with supporting technical justification for any increases or decreases in parking requirements. 2. Property owners with existing zoning and approvals that have obtained discretionary permits have vested property rights. Imposing additional parking requirements is illegal under the U.S. Constitution's Fifth Amendment as interpreted by the U.S. Supreme Court.
