PERFORMANCE CONTRACTING SERVICES FOR COUNTY
HAWAII--CONSIDERATION
Attached are copies that I received from John Kimura, Darren T. Kimura, Alden Chai and
Hugh H. Willocks regarding a Request For Proposal (RFP) B-3404.
Each of the respective persons indicates that the County is on the right tract in our attempt to
reducing unnecessary energy waste.
However, the RFP B-3404 does not provide the opportunity for the smaller, local contractors to
competitively submit bid.
The contractors would like to have the RFP breakdown and separate the scope of work into
smaller increments. This will ensure a competitive process, which will benefit all parties
involved. I wholeheartly agree with this.
I plan to refer this to the Committee on Public Work & Parks for discussion, however, the
problem that I face is it will not make the committee agenda on time. The deadline for the RFP
is March 13, 1998. is there anything that can be done to change the RFP or help to alleviate this
problem?

1 We apprec[ate the opportuNry to submit this Request for Proposal numbered 8.3408. We absolutely
ii agree and support the County in its oblective of Bald proposal [hat "an ongoing goal of the County of
1 Hawaft Is w use energy more efficiently." We also concur that energy efficient measures are In the
best Interest far not only the County of Hawaii but especially for those local companies who call
• Hawaii County home. This is because of reduced overhead caws to the county, which translates into
local taxes being spent in other benefidal means, and cotutruc[lon to ensue such a proposal which
should translate Into opportunities to support [hose who support the county.
As we are all aware of, presently, Hawaii County's economy fs facing slow growth and pose-recession
stagnancy. Thus It would be in the best Interest of those who restde and work in Hawaii County that
any monies be spent locally. Unfortunately by mare of Performance Contracting outlined in RFP-
3408, this Is not possible.
Petfatmance Contracting In essence alienates lost businesses and focuses on larger companies t+/ith
sufficient financial background ro finance these protects "In house." Typically, because of the lack of
such qualifications, local coiitrattors do not have die opportunity to bid on these types of projects.
~ Thus the protect conuacc by default will be awarded ro a mainland firm who will undoubtedly attempt
co maximize profit by every means possible.
It Is we that the proposal states there should be "provisions to make appropriate use of locally
available skills and tabor" however, there are neither parameters nor regulating agencies to enforce
such a clause.
We hereby request that all locat[oru spedfied to RFP-83408 no[ including die Public Safety Building at •
349 Kapfolani St. and the Kona Police Station located off Queen Ka' ahumanu Hwy. be separated
from this proposal and bid indNlduaQy or in groups. We also request that die bid be opened to local
subconcractots via the procurement processes under typical non•perfonnance conrcacting measures.
This process wfR achieve the goal of keeping money within the County and ako allow comperidve
pricing for every location rather than favor one firm to submit anon-competitive quotation.

The reality of performance contracting !s the[ you do not get an equal submittal of proposals. Perhaps ,
In the realm of large business, performance consacting holds its own, but when dealing with the
Counties and the State of Hawall is does not allow an even playing field for local businesses where total
business should receive ac very least, an equal opportunity.
We appreciate immediate action taken as the Request For Proposal deadline approaches on March 13,
1998.

Dear Council Chairperson, Mr. James Arakaki;
The Hawaii Island Contractors' Association represents the interest of local Big island contractors.
Our members strive to maintain the highest quality of work while ensuring that bcal labor, local
suppliers and other local resources arc used first and foremost.
We applaud the county's efforlc at reducing unnecessary onergy waste es featured in 9eeuest for
~ Heal K 408 0 provide eneray oerforma,pce contracting services for various departments
County of Hawaii. This proposal is essenfially the first step at running an efflaent government by
cu rtalling electricity vests thus reducing the counties overhead.
However, the wording of certain sections in this "RFP" disturbs us. In brief. RFP-3408 offers two
sites for bid. These two sites include the Hito Public Safety Building. and the Kona Police Station.
The company awarded this contracl will thus be allowed to work on some 150+ different sites.
This is unfair to ell local conVactors who do not have the means to competitively bid on the first
portion of the RFP because of its different aspects but are able to competitively bid on the
following 150+ some sites.
In its current wording, only Mainland based energy service companies are able to competitively
bid this project as a prime contrador. Once a mainland firm is contracted, there are no measures
to insure that any Big Island contractor will even be considered as asub-contractor.
In ell fairness, we are requesting that this RFP bin re-wordzd and that an additional bid be offered
to Include on all other sites not including the Public Safety Building and the Kona Police Station.
This will allow an equal opportunity for Big Island contractors'o at least bid on one part of this
energy efficiency project.
Our contractors support the county by paying taxes antl contributing to the benefit of all on the
Big Island. We are simply requesting an equal opportunity to help keep these county dollars in
the County of Hawaii.

' It bas been brought to my attmtlon that this RFP not anty refers to the Public
Safety Buildings in Hilo(349 Kapiolani St) aad Kona (Queen K Huy) but also
numerous other buildings. While we mderstand the Cotmty's desire get the
best prices possible but we fed that due consideration must be given to local
businesses who live and work in oar community aad spend their hard earned
dollars here.
I would request that every attempt be made to size your RFP such that
smaller businesses have an equal opportunity. Vie appreciate the provisions
is your proposal to use local skills and labor, however you moat recognize that
these triads of provisions are uaenforeeabla
Please rnnsider separating all locations other rhea the two specified
above and bid them separately In sizes which will make them biddable by small
business.
I appreciate your immediate eoncideration of this situation. It is
extremdy important that the Counq• support small business to this matter.
