BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, EWM Investments LLC is the owner of a parcel of land, containing an area of 0.740 acre, more or less, being a portion of Tax Map Keys: (3)5-4-009:004 and 027, situate at Kapa`au, in the District of North Kohala, County and State of Hawaii, more particularly described in Exhibit "A" and delineated on Exhibit "B" attached hereto; and WHEREAS, the Department of Parks and Recreation desires to provide recreational activities for the public in North Kohala; specifically, a skate park facility on the subject property; and WHEREAS, EWM Investments LLC is desirous of donating the subject parcel to the County of Hawaii to help facilitate the creation of the skate pazk; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the Council may accept gifts, which include the donation of real property on behalf of the County of Hawaii. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article XIII, Section 13-12 of the Hawaii County Charter (2000), the County of Hawaii accepts the donation of real property consisting of 0.740 acre, more or less, identified as being a portion of Tax Map Keys: (3)5-4-009:004 and 027, situate at Kapa`au, in the District of North Kohala, County and State of Hawaii, and more particularly described in Exhibit "A" and delineated on Exhibit "B" attached hereto, from EWM Investments LLC. BE IT FURTHER RESOLVED that a letter of appreciation be sent to EWM Investments LLC. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor Hang Kim; (2) the Department of Parks and Recreation; (3) Assistant Corporation Counsel Gerald Takase; and (4) EWM Investments LLC, 2116 Redbird Circle, Las Vegas, Nevada 89119.
