Change of Zone Ordinance No. 94 99 (REZ 770)
Applicant: Wilfred Kita
Subject: Annual Progress Report and Administrative Time Extension

This is to acknowledge receipt of your annual progress report dated September 5, 1997, in
compliance with Condition K of the above-referenced ordinance effective September 13, 1994.
In addition, this is to acknowledge receipt of your letter dated October 15, 1997, requesting a
one-year time extension to Condition C of the above-referenced ordinance. We sincerely
apologize for the delay in responding.
Condition C of the above-referenced ordinance states:
"C. Final Subdivision Approval shall be secured within three (3) years from the
effective date of the ordinance. Subdivision plans shall delineate a 10-foot
future road-widening easement along the subject property's southern boundary
and which shall be dedicated to the County of Hawaii upon its request."
As stated above, the effective date of the ordinance was September 13, 1994, and as such,
Final Subdivision Approval should have been secured by September 13, 1997.
You have indicated that Mr. Kita's request for a time extension has been brought about due to
personal circumstances, and he has been unable to complete all the requirements for final
subdivision approval in the allotted time. J~

Condition L of the approved change of zone ordinance allows the Planning Director to grant
an extension of time for performance of conditions within the ordinance. We have determined
that non-performance is a result of circumstances beyond the applicant's control and not a
result of fault or negligence, and hereby grants athree-year extension of time until
September 13, 2000 to comply with Condition C.
Please be aware that should you request an additional extension of time, your request must be
forwarded to the Planning Commission through this office. A $250 filing fee, original and
twenty copies of the request shall be submitted when requesting an additional extension of
time. A public hearing to consider your request will be held within 120 days. After such a
hearing is conducted, the request and the Commission's recommendation will be forwarded to
the County Council.
As a reminder, the applicant is required to comply with all conditions as stated in the above-
referenced ordinance within their appropriate timetables. The next annual progress report will
be due on or before September 13, 1998.

an additional year in which to obtain final subdivision approval. Please be advised that
Mr. Kita has had our firm submit his preliminary subdivision application to your office. We
have received tentative approval and are currently in the process of fulfilling the conditions
for final approval. Due to personal circumstances, Mr. Kita has been unable to complete
all of the requirements for final approval in the allotted time.
