STATE OF HAWAII
A BILL FOR AN ACT
RELATING TO GENETICALLY MODIFIED COFFEE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
1 SECTION 1. The legislature finds that the Kona coffee
2 industry contributes significantly to the economic and cultural
3 vitality of Hawaii and that there is a desire to maintain the
4 unique brand identity and market price of Kona coffee.
5 The legislature further finds that there are concerns that
6 the high market price and the niche that the Kona coffee
7 industry enjoys will be eroded if it continues to be legal to
8 modify coffee genetically.
9 The purpose of this Act is to prohibit the introduction of
10 genetically modified coffee in the Hawaii market and at the same
11 time, permit research on genetically modified coffee in an
12 environmentally secure facility.
13 SECTION 2. Title 11, Hawaii Revised Statutes, is amended
14 by adding a new chapter to be appropriately designated and to
15 read as follows:

1 § -1 Genetically modified coffee; moratorium. (a)
2 Except as provided in subsection (b), no genetically modified
3 coffee shall be tested, propagated, cultivated, raised, or grown
4 in the State.
5 (b) A person may conduct research on genetically modified
6 coffee in an environmentally secure facility.
7 (c) The department of agriculture shall adopt rules under
8 chapter 91 to implement this section.
9 (d) As used in this chapter:
10 "Environmentally secure facility" means an enclosed
11 facility, such as a laboratory or greenhouse, in which
12 precautions exist to prevent the exchange of genetic material
13 between genetically modified coffee and non-genetically modified
14 coffee.
15 "Genetically modified" means alterations to a life form or
16 its living progeny at the nucleic acid level, using the
17 techniques collectively referred to as recombinant DNA
18 technology.
19 "Person" means an individual, corporation, partnership,
20 limited liability company, or any other legal entity.
21 "Recombinant DNA technology" means the transfer of genes,
22 regulatory sequences, or nucleic acid between hosts by the use

1 of vectors or laboratory manipulations and includes the
2 insertion, excision, duplication, inactivation, or relocation of
3 specific genes, regulatory sequences, or sections of nucleic
4 acid. This term does not apply to material or an organism
5 developed exclusively through traditional methods of breeding,
6 hybridization, or nondirected mutagenesis.
7 (e) This section shall be repealed on June 30, 2012."
8 SECTION 3. This Act shall take effect on July 1, 2007.
