Your Committee on Public Works & Intergovernmental Relations, to which was referred in
Communication 831, regarding Resolution 433-07, reports as follows:
Resolution 433-07, transmitted by Deputy Corporation Counsel Craig T. Masuda, via Communication No. 831,
dated November 20, 2007, accepting the dedication of Road Lots "A", "B" and "C," being portions of
Tax Map Keys: (3)2-4-010:001 and 132, situate at Waiakea, District of South Hilo, County and State of
Hawaii, from Kahaopea'03, LLC.
Kahaopea '03, LLC, is desirous of dedicating the subject parcels, including all subdivision improvements
thereon, to the County of Hawaii for road and drainage purposes, and the improvements have been inspected
and approved by the County of Hawaii Department of Public Works, Department of Water Supply, and the
Planning Department.
Article XIII, § 13-12 of the Hawaii County Charter provides that the Council may accept gifts which include
the dedication of land on behalf of the County of Hawaii.
There was no testimony from members of the public regarding the proposed acceptance.
Deputy Corporation Counsel Craig T. Masuda appeared before your Committee. Mr. Masuda commented that
Kahaopea '03, LLC met all requirements and is in full compliance according to County of Hawaii standards.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and intent of
Resolution 433-07, and recommends its adoption.
