Re: County Fuel Tax
The provisions of Section 243-5, Hawaii Revised Statutes, enable, empower, and authorize the
Council of the County of Hawai'i to determine the amount of the county fuel tax. The County's
current special fuel tax program was set in place in 1988 (Resolution 397-88) for a period of ten
years, and subsequently extended for another ten years (Resolution 192-97) is now subject to
sunset June 30, 2008. The three and eight-tenths cents per gallon has remained unchanged and
will continue to be used in accordance with highway improvement projects as appropriated by the
Department of Public Works. After considering the various and numerous highway needs and
improvements to be made within the county, we believe that the county fuel tax should be set
infinitely, unless otherwise amended by another resolution.
Enclosed is a resolution that will extend the County Special Fuel Tax program indefinitely.
Pursuant to HRS 243-5, Council shall conduct a public hearing and public notice of the hearing
shall be given in the county at least twice within a period of thirty days immediately preceding
the date of hearing. Given the time limitation that this proposal be in effect on July 1, 2008 and
the need for a public hearing to be held on this matter, the Department of Public Works requests
to waive the Finance Committee and have this resolution placed, at its earliest, onto a County
Council's meeting agenda.

A. REQUEST:
A resolution proposing the County of Hawai'i special fuel tax program be indefinite.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):

Re: (Resolution No. 504-08 A RESOLUTION AUTHORIZING EXTENSION OF
THE COUNTY OF HAWAII FUEL TAX)
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
