HomeMy WebLinkAboutRES 501 Draft 01 2006-2008 YY •I COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 501 O$ A RESOLUTION EXTENDING THE TEMPORARY DELAY OF COUNCIL ACTION ON REZONING APPLICATIONS IN THE DISTRICT OF SOUTH KOHALA UNTIL THE SOUTH KOHALA COMMUNITY DEVELOPMENT PLAN IS ADOPTED BY ORDINANCE, OR DECEMBER 1, 2008, WHICHEVER SHALL OCCUR FIRST. WHEREAS, Resolution No. 17-07, duly adopted by the County Council on January 4, 2007, temporazily delayed Council action on rezoning applications in the District of South Kohala to allow time for the South Kohala Community Development Plan to be completed; and WHEREAS, Resolution No. 17-07 stated that the temporary delay would expire upon adoption of the South Kohala Community Development Plan by ordinance, or January 5, 2008, whichever would occur first; and WHEREAS, though the original delay termination date of January 5, 2008, has expired, the South Kohala Community Development Plan process is still ongoing and an extension of time is necessary to allow for completion of this important community-based process; and WHEREAS, though Resolution No. 17-07 included a provision that would allow for extensions of time in increments of not more than six (6) months each, the development of such plans have shown to necessitate a longer period of time; and WHEREAS, this resolution would extend the temporary delay of Council action on rezoning applications in the District of South Kohala until the South Kohala Community Development Plan is adopted by ordinance, or December 1, 2008, whichever shall occur first; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that Council action on rezoning applications in the District of South Kohala be delayed until the South Kohala Community Development Plan is adopted by ordinance, or December 1, 2008, whichever shall occur first; and BE IT FURTHER RESOLVED, that temporary delay of Council action on rezoning applications shall not affect or apply to any and all federal, State and County community-based and/or self-help housing projects involving agencies and programs including, but not limited to, the following: • The State Department of Hawaiian Home Lands housing projects in accordance with its December 30, 2002 "Memorandum of Agreement Between the County of Hawaii and the Department of Hawaiian Home Lands; • The State Housing and Community Development Corporation of Hawaii ("HCDCH") program; • Public projects involving schools, water and sewer systems, and any other projects that specifically benefit the public's health, safety and welfare; and • The Habitat for Humanities program, elderly housing projects, and homeless shelters; and BE IT FURTHER RESOLVED, that all other provisions and statements within Resolution No. 17-07 are carried over with the adoption of this resolution; and BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the South Kohala Community Development Plan Steering Committee, Mayor Harry Kim, the County Planning Department, the Planning Commission, the Department of Public Works, and the Department of Finance.
