A RESOLUTION AMENDING RESOLUTION N0.44-07, DRAFT 2, BY EXTENDING
THE TEMPORARY DELAY OF COUNCIL ACTION ON REZONING APPLICATIONS
IN THE DISTRICT OF NORTH KOHALA THAT WOULD PERMIT TRANSIENT
LODGING ACCOMMODATIONS OR RE-DESIGNATE AGRICULTURAL LAND
INTO ZONING DISTRICTS WITH A MINIMUM LAND AREA LESS THAN TWENTY
(20) ACRES IN SIZE, UNTIL THE NORTH KOHALA COMMUNITY DEVELOPMENT
PLAN IS ADOPTED BYORDINANCE, OR DECEMBER 1, 2008, WHICHEVER SHALL
OCCUR FIRST.
WHEREAS, Resolution No. 44-07, Draft 2, duly adopted by the County Council on
February 22, 2007, temporarily delayed Council action on rezoning applications that would
permit transient lodging accommodations or re-designate agricultural land into zoning districts
with a minimum land area less than twenty (20) acres in size in the District of North Kohala to
allow time for the North Kohala Community Development Plan process to be completed; and
WHEREAS, Resolution No. 44-07, Draft 2, provided that the temporary delay would
expire upon adoption of the North Kohala Community Development Plan by ordinance, or
February 22, 2008, whichever would occur first; and
WHEREAS, the North Kohala Community Development Plan process is still ongoing
and an extension of time is necessary to allow for completion of this important community-based
process; and
WHEREAS, though Resolution 44-07, Draft 2, includes a provision that allows for
extensions of time in increments of not more than six (6) months each, the development of such
plans have shown to necessitate a longer period of time; and
WHEREAS, this resolution proposes a single amendment to Resolution No. 44-07, Draft
2, which is to provide a temporary delay of Council action on certain rezoning applications in the
District of North Kohala until the North Kohala Community Development Plan is adopted by
ordinance, or until December 1, 2008; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that
Resolution No. 44-07, Draft 2, is hereby amended to temporarily delay Council action on
rezoning applications that would permit transient lodging accommodations or re-designate
agricultural land into zoning districts with a minimum land area less than twenty (20) acres in
size in the District of North Kohala until the North Kohala Community Development Plan is
adopted by ordinance, or December 1, 2008, whichever shall occur first; and
BE IT FURTHER RESOLVED, that temporary delay of Council action on rezoning
applications shall not affect or apply to any and all federal, State and County community-based
and/or self-help housing projects involving agencies and programs including, but not limited to,
the following:
• The State Department of Hawaiian Home Lands housing projects in accordance with
its December 30, 2002 "Memorandum of Agreement Between the County of Hawaii
and the Department of Hawaiian Home Lands;
• The State Housing and Community Development Corporation of Hawaii
("HCDCH") program;
• Public projects involving schools, water and sewer systems, and any other projects
that specifically benefit the public's health, safety and welfare; and
• The Habitat for Humanities program, elderly housing projects, and homeless
shelters; and
BE IT FURTHER RESOLVED that all other provisions and statements within
Resolution No. 44-07, Draft 2, are carried over with the adoption of this resolution; and
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the North Kohala Community Development Plan Steering Committee, Mayor Harry
Kim, the County Planning Department, the Planning Commission, the Department of Public
Works, and the Department of Finance.
