HomeMy WebLinkAboutRES 518 Draft 01 2006-2008 ~~tv os N~ki . lug COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 518 U8 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF TRANSPORTATION, PURSUANT TO HRS 46-7, FOR A TRAFFIC SAFETY TRAINING PROJECT WHEREAS, the State of Hawaii Department of Transportation's Safe Community Traffic Safety Program has authorized a Highway Safety Project grant to the Hawaii Office of the Prosecuting Attorney aimed at improving enforcement and prosecution of traffic laws; and WHEREAS, the mission/goal of this project is to make our roads safer and improve the performance of the law enforcement system in its efforts to enforce traffic laws by holding inter- agency meetings between police and prosecutors and by training deputy prosecuting attorneys in the conceptual, technical, scientific and trial aspects of these offenses; and WHEREAS, this grant, derived from federal funds, will be used to implement a project that includes: assignment of a deputy prosecuting attorney to be the Statewide Traffic Safety Resource Prosecutor, providing statewide training for police and prosecutors, developing modular trial advocacy training for deputies, and participation at monthly statewide traffic commanders meetings; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, an agreement with the State of Hawaii Department of Transportation, to enable the County to implement the Traffic Safety Training Project as described in the application submitted to the Department of Transportation, attached hereto and incorporated herein by reference as Exhibit "A". BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Office of the Prosecuting Attorney, and the Finance Department. Title Highway Safety Manager EXHIBIT II SCHEDULE A SCHEDULE A (PROSECUTORS TRAINING) (Project Number) MISSION/GOAL The mission/goal of the prosecutor's training project is to make our roads safer and improve the performance of the law enforcement system in its efforts to enforce traffic laws by holding inter-agency meetings between police and prosecutors and training deputy prosecuting attorneys in the conceptual, technical, scientific and trial aspects of these offenses. STRATEGIES • Create a position for a State wide Traffic Safety Resource Prosecutor, who will coordinate traffic related training for prosecutors in the State of Hawaii and be available to answer traffic related questions form other deputy prosecutors in the State of Hawaii. • Have the Traffic Safety Resource Prosecutor attend every traffic commanders meeting; coordinate a separate prosecutor's meeting to be held in conjunction with the traffic commanders meeting; be responsible for coordinating the agenda for the prosecutor's meeting, to include discussion of traffic enforcement and prosecution issues facing all counties in the State. • Have an Attorney General representative who handles legislation attend one of the traffic commanderlprosecutor quarterly meetings to coordinate to discuss legislative concerns. • Have the Traffic Safety Resource Prosecutor and a deputy prosecutor who co-chairs the Governor's Highway Council attend the 2008 Lifesavers Conference in Portland, Oregon in April of 2008 and other traffic related trainings and/or events. • Have the Traffic Safety Resource Prosecutor develop, update and arrange modulaz trial advocacy training for deputy prosecutors who will be handling district (traffic) court. • Conduct a "Train the Trainer Training" to facilitate the modulaz trial advocacy training and to offer local prosecutors the opportunity to benefit from the adult teaming model as it applies to trial advocacy. • Conduct one two-day state-wide basic trial advocacy training on Hawaii's DUI traffic laws and contemporary trial techniques. Train and improve the trial advocacy skills of at least 15 deputy prosecutors who handle traffic cases from aoound the state at least two of which would be from each county. SOLUTION/IMPLEMENTATION • Implementation will include flying in at least 2 expert trainer/consultants from the mainland to help in the presentation of the trainings. • Implementation also includes flying in at least 2 experienced local trainers/consultants from the State of Hawaii, to help in the presentation of the training courses. • Implementation also includes flying in and housing at least 10 local deputy prosecutors from around the state to be trained. • Other expenses include flying deputy prosecutors to neighbor islands and the mainland to attend the police commanders meetings and the Lifesavers conference. • Other expenses also include preparation of written materials and training room expenses. EVALUATION • The goal is is train at least 15 Deputy Prosecuting Attome~~s from around the State of Hawaii and make them better preps ed to handle traffic related cases. • Participants will fill out a survey designed to measure the benefits of the training process, the amount of information or knowledge gained as a result of their participation, the usefulness of the material covered, and the likelihood of such being applicable to cases they encounter. Also list the task(s) to be accomplished. E.g. training, enforcement, classes, etc. • A training committee composed of deputy prosecutors and police from each county will be formed to ensure local issues and strategies are addressed. • Create a data base of relevant and new traffic impairment cases and laws. • Prepare basic training "primer" manual for new deputies, and send out to other prosecutor's offices in the State of Hawaii. ~ EXHIBIT III SCHEDULE B SCHEDULE B (1) PERSONAL SERVICES C.
