Your Committee on Planning, to which was referred Resolution No. 482, reports as follows:
Resolution No. 482, transmitted via Communication No. 910 from Christopher J. Yuen, Planning
Director, dated December 24, 2007, transmitting the proposed Resolution Authorizing Approval
of In Lieu Fair Share Contribution to Satisfy Condition "K" of Change of Zone Ordinance No.
96-121 regarding HILO ONE, INCORPORATED, landowner of approximately 23.856 acres
of land at Paukaa, South Hilo, Hawaii, TMK: (3) 2-7-3: 27.
Resolution No. 482 requests Council consideration and approval of the in lieu actual cost of
roadway improvements in the amount of $48,648.00 to offset the full amount of the fair share
contribution to support road and traffic improvements, as required in Condition "K" of Change
of Zone Ordinance No. 96-121.
Condition "G" of Change of Zone Ordinance No. 96-121 requires that the portion of the Old
Mamalahoa Highway fronting the subject property from the southern or Hilo boundary up to the
designated street access point into the subject property shall be improved to a 20-foot wide
pavement with 6-foot wide paved shoulders.
Communication No. 482 states that Condition "K" requires landowner to comply with the
requirements of Fair Share Contribution to mitigate potential regional impacts of the subject
property with respect to fire, police, solid waste and disposal facilities, and roads. Condition "K"
also provides that the cost of constructing roadway improvements required in Condition "G"
noted above, and any roadway improvements required by the State, shall be credited against the
sum specified in Condition "K," subsection (4), relating to road and traffic improvements. It
further provides that in lieu of paying the fair share contribution, the landowner may construct
and contribute land, improvements/facilities related to parks and recreation, fire, police, solid
waste disposal facilities and roads within the region impacted by the proposed development,
subject to approval of the director.

A September 20, 2007 letter from GW Construction to Hilo One, lnc. states that the road
widening improvements of the Old Mamalahoa Highway has been completed at a cost of
$48,648.00.
The Planning Director reviewed and approves the actual cost of the roadway improvements in
the amount of $48,648.00 to satisfy the in lieu fair share contribution and requests that the
Council approve the in lieu actual cost of roadway improvements in the amount of $48,648.00 to
offset the full amount of the fair share contribution to support road and traffic improvements as
required by Condition "K".
At the January 23, 2008 Planning Committee meeting, Director Yuen stated that an ordinance
passed some years ago provided that all in lieu requests for fair share be brought to the Council
for approval. Resolution No. 482 requests that the construction cost of improvements to the Old
Mamalahoa Highway be credited against the Fair share and Resolution No. 482 requests such a
credit.
Your Committee on Planning is in accord with the purpose and intent of Resolution No. 482 and
recommends its adoption.
