Subject: Response to Letter Dated January 15, 2008 Tax Mau Key: 2-248:13 This is to acknowledge receipt of your letter dated January 15, 2008, informing the Planning Director that you no longer have plans to develop the pitch and putt golf course and therefore request that Condition B be amended to delete the portion of the condition limiting the number of lots to 22. The effective date of Change of Zone Ordinance No. 95 55 is April 26, 1995. Condition B of Change of Zone Ordinance No. 95 55 states that final subdivision approval be secured within five years from the effective date of the ordinance (or April 26, 2000). A five-year administrative time extension to comply with Condition B was granted until April 26, 2005. Subdivision 2003-0092 received Tentative Approval on December 17, 2003. Your amendment request for a 2-year time extension would only be until April 26, 2007. As confirmed via telephone, the Planning Department will revise your initial 2-year time extension request to a 5-year time extension, which will include the time that has lapsed since April 26, 2005. If approved by the Hawaii County Council, the compliance date for Condition B would be until April 26, 2010. Tax Map Key: 2-2-48:013 & 093 Dear Mr. Yuen; The initial Change of Zone Application REZ 94-19 requested a change of zone for the areas covered by the proposed subdivision and golf course so that there would be flexibility regarding layout of the golf course and subdivision lots. The number of proposed lots was limited to 22 due to the proposed 9-hole pitch and putt golf course. Condition B of Change of Zone Ordinance No. 95-55 (REZ 792) states that upon Final Subdivision Approval that the Planning Director would initiate a change of zone into an Open-zoned District classification for the lands covered by the proposed 9-hole pitch and putt golf course. We no longer have plans to develop the pitch and putt golf course and request that the condition limiting the number of lots to 22 be removed from the Change of Zone Ordinance.
