Report Title:
Smoking; Public Beaches, Parks, Recreational Areas; Disposal
Description:
Prohibits smoking on public beaches and parks and certain
recreational areas. Prohibits disposal of smoking waste in any
place where smoking is prohibited, except in designated waste
disposal container. Subjects violators to $250 fine.

A BILL FOR AN ACT
RELATING TO SMOKING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 328J, Hawaii Revised Statutes, is
amended by adding two new sections to be appropriately
designated and to read as follows:
"§328J-A Disposal of smoking waste. (a) No person shall
dispose of any cigarette, cigar, or tobacco product, or any part
thereof, in any place where smoking is prohibited under this
chapter, except in a designated waste disposal container.
(b) Any person who violates this section shall be fined
not more than $250.

§328J-B Prohibition in certain places open to the public.
Smoking shall be prohibited in the following areas open to the
public:
(1) Public beaches and public parks; and
(2) In any area where smoking is otherwise not prohibited,
any place within twenty-five feet of playground
equipment installed for public use by children, play
pits, play structures, bleachers, backstops, sports
fields, ball diamonds, basketball, handball, tennis,
and paddle tennis courts, and areas in which notice is
posted that permits are required to reserve the area
for picnics."
SECTION 2. This Act does not affect rights and duties that
matured, penalties that were incurred, and proceedings that were
begun, before its effective date.
SECTION 3. In codifying the new sections added by section
1 of this Act, the revisor of statutes shall substitute
appropriate section numbers for the letters used in designating
the new sections in this Act.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
