Dear Chairman Hoffinann and Council Members:
Amendment to Ordinance No. 08-2
Wind Energy Facilities in Open District
The attached bill is submitted for the County Council's consideration in order to correct
an oversight in our drafting of Ordinance No. 08-2, which was recently adopted.
Specifically, subsection (c) of section 25-5-162, Chapter 25, Hawaii County Code 1983
(2005 edition, as amended) was inadvertently left out the bill. In adopting Ordinance
No. 08-2 as initially drafted, subsection (c) was deleted. The attached bill is intended to
correct this oversight by re-inserting subsection (c). Because this change is a technical
correction of Ordinance No. 08-2 that previously went to the Planning Commission and
does not change the intent of that ordinance, this bill does not have to go to the Planning
Commission.

Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Planning to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Planning for placement on its future agenda.
