RESOLUTION NO. 551 08
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR
CONTRACT FOR AWASTE-TO-ENERGY FACILITY
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or more than one
fiscal year be approved by resolution; and
WHEREAS, the Hilo Landfill is anticipated to close in approximately four years; and
WHEREAS, the County issued a Request For Proposal (RFP) to provide an alternative
method of disposing of the solid waste currently handled by the Hilo Landfill; and
WHEREAS, the preferred proposal pursuant to the RFP was for aWaste-To-Energy facility;
and
WHEREAS, construction of aWaste-To-Energy facility requires capital investment; and
WHEREAS, when this investment can be depreciated over more than one year, annual costs
to the County will be more competitive; and
WHEREAS, the RFP called for adesign-build-operate proposal; and
WHEREAS, the County now finds it in its best interest to contract for private services of a
provider to design, build and operate aWaste-To-Energy facility with atwenty-year agreement, with
one five-year option to extend contracted services.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that in accordance with Article X, Section 10-11 of the Hawaii County Charter, the Mayor is hereby
authorized to enter into amulti-year contract for services of designing, building and operating a
Waste-To-Energy facility subject to a six month review period for value engineering with an option
to cancel by the County Council and a review after completion of the EIS and power purchase
agreement with an option to cancel by the County Council, and that sufficient funds be budgeted in
future fiscal years to cover the anticipated obligation of the County under the terms of the
agreement.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii shall transmit copies of
this resolution to the State of Hawaii Department of Health, the Office of the Mayor, and the
Departments of Finance and Environmental Management.
