SUBJECT: Proposed bill for an ordinance to initiate a Charter amendment to article XI of the
Hawaii County Charter (2000), relating to initiative and referendum.
Attached for your consideration is a bill for an ordinance to initiate a Charter amendment to article XI
of the Hawaii County Charter (2000), relating to initiative and referendum. This bill would repeal
article XI in its entirety and replace it with new language.
The proposed new article XI includes the following changes to existing provisions in the Charter:
1. Adds a new section entitled "Initiative and Referendum Process." This section describes an
amended version of the initiative and referendum process that incorporates in part, provisions
relating to submission requirements, procedures after filing initiative or referendum petitions,
and council actions on petitions. Sections 11-2, 11-5, and 11-6, that address these steps of the
process in the present language of the charter, are deleted in this proposed revision.
2. Adds a new definitions section.
3. Amends section 11-3 by adding provisioms that establish a committee chair.
4. Amends section 11-4, relating to the form and sufficiency of initiative and referendum petitions.
5. Amends section 11-8, relating to the election results.
6. Makes various other changes.
