ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 15, SECTION 2-91.1(a), HAWAII
COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO FILING OF
FINANCIAL DISCLOSURES BY REGULATORY EMPLOYEES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. In 2000, the voters of the County of Hawai i amended the Hawai~ i
County Charter to create the Department of Environmental Management. Prior to this Charter
amendment, the divisions currently under the Department of Environmental Management belonged to
the Department of Public Works. Presently, pursuant to Chapter Z, Article 15, Section 2-91.1 of the
Hawai' i County Code 1983 (2005 Edition, as amended), only regulatory employees of the Department
of Public Works, and not the Department of Environmental Management, are required to file financial
disclosures. The purpose of this ordinance is to correct this obvious oversight, and to provide that
regulatory employees from the Department of Environmental Management are required to file financial
disclosures.
SECTION 2. Chapter 2, Article 15, Section 2-91.1(a), Hawaii County Code 1983 (2005
Edition, as amended), is amended as follows:
(a) Definitions. The following words used in this section shall have the respective meanings in
this section:
(1) "Candidate" has the meaning given it by section 11-191(3),* Hawaii Revised Statutes;
(2) "Elective" means all elective offices of the County of Hawaii;
(3) "Income" means gross income defined by section 61 of the Internal Revenue Code of 1954;
(4) "Regulatory employee" means:
(A) Supervisors of inspectors employed by the department of public works and
department of environmental mana eg ment;
(B) Inspectors employed by the department of public works and department of
environmental management;
{C) Supervisors of liquor control investigators;
(D) Liquor control investigators;
(E) Buyers and purchasing agents;
(F) Supervisors of real property tax appraisers;
(G) Real property tax appraisers;
(H) Planners employed by the planning department;
Q) Supervisors of inspectors employed by the department of water supply;
(J) Inspectors employed by the department of water supply;
(K) The legislative auditor.
SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In
printing this ordinance, the brackets, bracketed material, and underscoring need not be included.
SECTION 4. If any provision of this ordinance or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the
ordinance that can be given effect without the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
