SUBJECT: Proposed Amendment to Resolution No. 537-08, Relating to the Appropriation of
Contingency Relief Funds from District 9 to the North Kohala Community
Resource Center, a 501 (c)(3) non-profit organization, to help fund the Kohala
Ditch Project
Please find attached a proposed amendment to Resolution No. 530-08, relating to the
appropriation of Contingency Relief Funds from District 9 to the North Kohala Community
Resource Center, a 501 (c)(3) non-profit organization, to help fund the Kohala Ditch Project to
be proposed at the Council meeting scheduled on March 12th 2008.
The proposed amendment relating to the number of irrigated farms and ranchers depending on
the Kohala Ditch, is illustrated via Ramseyer format, and reads as follows:
"WHEREAS, the Kohala Ditch Project, a pumping / irrigation project initiated to help
maintain water supply to North Kohala farmlands, is now vital in sustaining no less than 17

As incorporated into the attached proposed draft 2, this clause would amend the 3rd WHEREAS
clause in Resolution No. 537-08.

A RESOLUTION TRANSFERRING/APPROPRIATING AN APPROPRIATION OUT
AND FROM THE DESIGNATED FUND ACCOUNT(S) AND CREDITING SAME TO A
DESIGNATED FUND ACCOUNT(S)
WHEREAS, the Kohala Ditch has since the early 1900s provided water irrigation to
North Kohala farmlands; and
WHEREAS, the Kohala Ditch was seriously damaged during the 2006 Kiholo
earthquake, diminishing its output severely; and
WHEREAS, the Kohala Ditch Project, a pumping / irrigation project initiated to help
maintain water supply to North Kohala farmlands, is now vital in sustaining no less than 17 dairy
farmers and ranchers; and
WHEREAS, the Kohala Ditch Project has requested from District 9 that funds be
appropriated to their cause in order to help preserve reliable and effective water supply for
agricultural North Kohala lands prior to and in case of regional disaster; and
WHEREAS, the North Kohala Community Resource Center; a 501(c)(3) non-profit
organization will act as fiscal sponsor for the Kohala Ditch; and
WHEREAS, Contingency Relief funds from Council District 9 will be appropriated to
Civil Defense Agency, to be used to fund the overall technical and development efforts to
maintain water supply in North Kohala agricultural lands; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
following amount be and is hereby transferred/appropriated as set forth below:

BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Civil Defense Administrator and the Director of Finance and that the Director of
Finance is hereby authorized to make the necessary transfers in accordance with the terms of the
resolution.
