Angel Pilago, dated February 6, ZOOS, transmitting a resolution amending Resolution 16-07, Draft 2, by further extending the temporary delay of Council action on rezoning applications in the Districts of North and South Kona until the North and South Kona Community Development Plan is adopted by ordinance, or December 1, 2008, whichever shall occur first. Resolution 529-08 states that Resolution 16-07, Draft 2, duly adopted by the County Council on January 4, 2007, temporarily delayed Council action on rezoning applications in the District of North and South Kona until the North and South Kona Community Development Plan is adopted by Ordinance, or September 1, 2007. Resolution 529-08 further states that Resolution 320-07, duly adopted by the County Council on September 6, 2007, proposed a single amendment to Resolution 16-07, Draft 2, and extended the temporary delay of Council action on rezoning applications in the Districts of North and South Kona until the North and South Kona Community Development Plan is adopted by ordinance, or March 2008, whichever shall occur first. Resolution 529-08 states that although Resolution 16-07, Draft 2, included a provision that would allow for extensions of time in increments of not more than six (6) months each, development of such plans have shown to necessitate a longer period of time. Therefore, Resolution 529-08 proposes a further singular amendment to Resolution 16-07, Draft 2, providing for anine-month extension of time for the temporary delay of Council action on rezoning applications in the Districts of North and South Kona until the North and South Kona Community Development Plan is adopted by ordinance, or December 1, 2008, whichever shall occur first. At the February 20, 2008 Planning Committee meeting, testimony in support was presented by Mr. Curtis Tyler who noted that this was the right thing to do. Council Member Ford expressed her support noting that the CDP process is nearing the end. In response to Council Member PC Report No. 72 Communication 1003 Resolution 529-08 Page 2 of 2 Yagong's question whether Director Yuen had received any feedback from the community relating to further extension of the temporary delay, Director Yuen stated there were none. Committee Chair Pilago noted there has been positive interface among all those involved and Council Chair Hoffmann also expressed that he has in fact heard from developers and that honestly he had not heard anyone complain. Mr. Yagong stated he recognizes this proposal concerns local issues, but only wanted to apprise everyone that the construction industry is coming to a standstill, but that he would support the measure.
