SUBJECT: Proposed Amendment to Resolution No. 530-08, Draft 2, Relating to-the r
Exemption of Certain Code Requirements, Pursuant to Sections 20tH'38 and
201H-44 of the Hawaii Revised Statutes, for the Proposed West Hawai'irn
Emergency Housing Program in Kailua Kona
Please find attached a proposed amendment to Resolution No. 530-08, Draft 2, relating to the
exemption of certain code requirements for the West Hawaii Emergency Housing Program in
Kailua-Kona, to be proposed at the Council meeting scheduled on March 25, 2008.
The proposed amendment relating to recycling capabilities for this emergency housing project, is
illustrated via Ramseyer format, and reads as follows:
"WHEREAS, the OHCD will ensure that the design consultant is instructed that the
project shall be LEED (Leadership in Energy and Environmental Design) certified[:] and
WHEREAS the OHCD will ensure that the design consultant and the operator of the
facility will be instructed that they design the facility to make it recycling friendly and to
encourage the participants to recycle."
As incorporated into the attached proposed draft 2, this clause would be inserted as the last
WHEREAS clause in Resolution No. 530-08, Draft 2.

RESOLUTION AUTHORIZING THE EXEMPTION OF CERTAIN CODE
REQUIREMENTS, PURSUANT TO SECTIONS 20111-38 AND 20111-44 OF THE
HAWAII REVISED STATUTES FOR THE PROPOSED WEST HAWAII
EMERGENCY HOUSING PROGRAM IN KAILUA-KONA
WHEREAS, the Office of Housing and Community Development ("OHCD") has made
several attempts to develop an emergency housing program in West Hawaii over a period of
more than 20 years; and
WHEREAS, the OHCD now wishes to construct an emergency housing program for
homeless individuals on County-owned land in Kailua-Kona, Hawai' i, identified as tax map key
3/7-4-010: portion of 020, to provide decent, safe and sanitary emergency housing and
supportive services to qualified homeless individuals in the County of Hawai' i ("County"); and
WHEREAS, the OHCD has secured funding for the planning, design and construction of
the Program from the U.S. Department of Housing and Urban Development ($819,113), State
($500,000), and County ($500,000), totaling $1,819,113; and
WHEREAS, the Program will serve as the initial component of the housing continuum
in assisting homeless individuals secure transitional and/or permanent housing; and
WHEREAS, the proposed West Hawaii Emergency Housing Program ("Program") will
function in collaboration with The Friendly Place (daytime service center) and the future Kaloko
Housing Program (transitional and permanent housing program); and
WHEREAS, the Program will be in close proximity to supportive services, employment,
educational and other essential resources; and
WHEREAS, Section 201H-38 and 201H-44 of the Hawaii Revised Statutes ("HRS")
allows affordable housing projects, including commercial or industrial properties developed in
connection with dwelling units, to be exempt from certain laws and rules contingent upon
County Council approval of the project; and
WHEREAS, Section 46-15.1 of the HRS grants to the County the same powers subject
to applicable limitations as those granted to the Hawaii Housing Finance and Development
Corporation under Section 201 H of the HRS; and
WHEREAS, the Program will promote the goals contained in Sections 201H-38 and
201H-44 of the HRS, and Chapter 2, Article 13, of the Hawaii County Code ("Code"); and
WHEREAS, the OHCD is seeking exemptions from Minimum Lot Size (Section 25-5-
154 of the Code); Minimum Building Average Width (Section 25-5-155 of the Code); Kailua
Village Design (Section 25-7-4(b) and (c) of the Code); Setbacks (Section 25-5-156 of the
Code); Plan Approval (Section 25-5-157(c) of the Code); Landscaping (Planning Department
Rule 17); and Parking (Department of Water Supply Article 4, Chapter 25); and
WHEREAS, the OHCD will ensure that the design consultant is instructed that the
project shall be LEED (Leadership in Energy and Environmental Design) certified; and
WHEREAS, the OHCD will ensure that the design consultant and the operator of the
facility will be instructed that they design the facility to make it recycling friendly and to
encourage the participants to recycle.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the conceptual sketch of the West Hawai' i Emergency Housing Program site
and the preliminary plans and specifications for the Project attached hereto as "Exhibit A" are
hereby approved.
BE IT FURTHER RESOLVED, that pursuant to provisions of Section 201H-38 of the
HRS, the Mayor of the County of Hawaii or his duly authorized representative shall be the
County official responsible for certifying maps and plans of lands connected with the West
Hawaii Emergency Housing Program as having complied with applicable laws.
BE IT FURTHER RESOLVED, that the Mayor of the County of Hawaii or his duly
authorized representative is hereby authorized to execute other documents required to develop
the West Hawaii Emergency Housing Program.
BE IT FURTHER RESOLVED, that a copy of this resolution be transmitted to the
Planning Director of the County of Hawaii, and the Office of Housing and Community
Development.
