AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 2, OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO CIVIL DEFENSE DISASTER CONTROL. SECTION 1. The purpose of this measure is to increase the effectiveness of civil defense ordered evacuations during impending disasters or disasters by amending section 7-6, definitions, to add Civil Defense Agency designees as authorized persons. SECTION 2. Section 7-6, Hawaii County Code 1983 (2005 edition, as amended), is amended to read as follows: Section 7-6. Definitions. As used in this article: (1) "Authorized person" means any: (a) Police officer or County or State employee assigned to disaster duty during an impending disaster or disasters; (b) National Guard members; (c) Civil defense agency personnel, volunteers[.],or designees. (2) "Disaster" means any situation, usually catastrophic in nature, where numbers of persons are plunged into helplessness and suffering and as a result may be in need of food, clothing, shelter, medical care, or other necessities of life, and the governor of the State or the mayor of the County has declared a state of disaster or emergency. (3) "Impending disaster" means any situation where a catastrophe threatens an inhabited area and the civil defense agency has issued a warning that the inhabitants of the area should evacuate from the threatened area. SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be included. SECTION 4. Severability. if any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 5. This ordinance shall take effect upon its approval.
