SUBJECT: DEVELOPMENT AGREEMENT
OCEANSIDE 1250
It has come to our attention that several landowners who are affected by the Mamalahoa
Highway Bypass, have asked for a clarification on the provisions of the fair share assessment
or impact fees should they be adopted.
According to Section 12 c. no fair share assessment or impact requirement would be imposed
on landowners who donate their land and who develop their land in conformance with existing
zoning. Please be advised that this exemption includes a subdivision or consolidation/
resubdivision of lands under existing zoned provisions.
