RE: Transmitting Bill 262, Draft 2, (A proposed charter amendment relating to
establishing an independent audit function within the legislative branch through
the Office of the Legislative Auditor)
Attached please find a draft 2 of bill 262, relating to establishing an independent audit function
within the legislative branch through the Office of the Legislative Auditor. This draft contains
the amendments to draft 1 of this bill that were made by the Council during its meeting on
April 9, 2008. These amendments are expressed in communications no. 1067.5 and no. 1067.6.
The Council also amended the proposed amendment contained in communication no. 1067.6 by
removing the last paragraph of the proposed new language. Specifically, the language that was
removed reads as follows:
"False swearing by any witness shall constitute perjury and shall be referred by
the auditor to the prosecuting attorney for prosecution. In any audit which
concerns the alleged gross misconduct or alleged criminal conduct on the part of
any individual, such individual shall have the right to be represented by counsel
and the right to have the auditor compel the attendance of witnesses on behalf of
the individual."
