Dear Chair Hoffmann and Members of the County Council:
SUBJECT: Bill 266, Draft 2, Planning Commission review of Community
Development Plans
The Planning Department must request a slight amendment to this bill, which sets a
maximum time frame for the Planning Commission's review of a draft community
development plan, to make it clear that the sixty day period begins with the Planning
Commission's receipt of the Planning Director's recommendation, rather than the physical
receipt of the plan. This is so that the Planning Commission will have three meetings to
hear public testimony, discuss, and vote on the plan. The first plan sent to the Planning
Commission was the Puna Community Development Plan. The Planning Department
gave copies to the Planning Commission about two weeks before sending them the
recommendation. If the sixty day period ran from the actual receipt of the copies, there
would be time for the Planning Commission to consider the plan at only two meetings,
and the vote would have to be taken at a West Hawaii meeting. If it runs from their
receipt of the recommendation, the Planning Commission will vote on the plan at their
June 6 meeting and the Planning Department will promptly move the plan and
recommendation to the Council.

We respectfully request that Section 2 of the bill be amended to read as follows, with the
new wording we request underlined:
"Section 2-28A. Community Development Plan.
Within sixty days after receipt of the planning director's recommendation on a
draft community development plan or any amendment thereof, the planning
commission shall transmit the draft community development plan or any
amendment with its recommendation through the mayor to the county council.
The commission shall recommend approval in whole or in part, with or without
modifications, or rejection of the community development plan or any amendment.
In the event the planning commission fails to act on the community development
plan or amendment within the sixty-day period, such inaction shall be considered
as an unfavorable recommendation by the planning commission, and the
community development plan or amendment shall then be submitted through the
mayor to the county council with such recommendation."
