Proposed Charter Amendment to Create 1 wo Planning Commissions
Dear Chairman Pilago and Members:
Resolution 628-08 directs the County Clerk to place the Charter amendment proposed by
Ordinance No. 08-01 on the 2008 General Election ballot for approval by the voters of the County. This
includes submission of ballot language to the state chief election officer prior to 4:30 p.m., September 5,
2008, pursuant to section 11-1 19(b) Hawaii Revised Statutes. While it is the responsibility of the
County Clerk to draft ballot questions, I am requesting that this communication be agendized with
Resolution 628-08, so that Council Members will be able to provide comment on my proposed ballot
language which is as follows:

PROPOSAL I. Planning Commission. Should the County Charter be changed to increase
the number of planning commissions for Hawaii County from one for the entire county to two, a
windward planning commission and a leeward planning commission?
PRESENT PROVISION: Presently Sections 6-4.1 through 6-4.3 of the County Charter
provide for a single planning commission of nine members, one from each council district.
PROPOSED AMENDMENT: If approved, the County Charter would be amended to provide
for two seven-member commissions: 1) a windward planning commission for the North Hilo, Hamakua,
Ka'u, Puna and South Hilo judicial districts comprised of one member selected from the North Hilo and
Hamakua judicial districts, one member each from the Ka'u, Puna and South Hilo districts, and three
"at-large" members; and 2) a leeward planning commission for the South Kona, North Kona, South
Kohala and North Kohala judicial districts comprised of one member from each of these districts and
three "at-large" members. No more than two members of either commission shall be from the same
judicial district. Each commission would act on land use changes and community development plans
within its own respective jurisdiction, but meet jointly for matters affecting both commissions.
