RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR
AGREEMENT FOR FURNISHING AND IMPLEMENTING AN ORGANICS DIVERSION
PROGRAM AT THE WEST HAWAII COMPOST & BIODIESEL FACILITY FOR THE
DEPARTMENT OF ENVIRONMENTAL MANAGEMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or more than one
fiscal year be approved by resolution; and
WHEREAS, the County is in the construction phase for the Materials Recovery Facility
infrastructure for West Hawaii at the Pu`uanahulu Landfill with scheduled project completion of late
summer 2008; and
WHEREAS, a Compost &Biodiesel operation will divert organic materials from County
transfer stations and landfills including greenwaste, untreated wood, biosolids and FOG's (Fats, Oils
& Grease); and
WHEREAS, a Compost &Biodiesel operation will provide valuable products such as compost
and mulch for local consumers and make available to the County alternative fuel in the form of
Biodiesel; and
WHEREAS, the start-up of a Compost &Biodiesel Facility requires a capital investment to be
depreciated over many years; and
WHEREAS, the County finds it in its best interest to contract for private services of a
contractor to operate a West Hawaii Compost and Biodiesel Facility with aten-year agreement, with
one (1) 12 month option to extend contracted services; and
WHEREAS, the Update to the Integrated Solid Waste Management Plan identified recycling
and waste diversion as major activities to help the County reach its goal to divert 50% of all solid
waste that would otherwise go to a landfill, by 2008 and 80% by 2013; and Resolution 28-03 Draft 2
was approved by Council on January 23, 2003, setting forth these goals and policies; and
WHEREAS, Organic diversion programs like Compost &Biodiesel diverts material out of the
waste stream, preserves natural resources and prolongs the life of the landfills.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that in accordance with Article X, Section 10-11 of the Hawaii County Charter, the Mayor is hereby
authorized to enter into amulti-year contract for services of implementing and furnishing an organic
diversion program at the West Hawaii Compost and Biodiesel Facility for the Department of
Environmental Management and that sufficient funds be budgeted in future fiscal years to cover the
anticipated obligation of the County under the terms of the agreement.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii shall transmit copies of
this resolution to the Office of the Mayor, and the Departments of Finance and Environmental
Management.
