HomeMy WebLinkAboutCOM 1089.003 2006-2008 Big Island Dance Club, LLC l 400 Hualani Street Suite 22 Hilo, Hawaii 96721 (808) 933-2667 ~r 07 I August, 22, 2007 CD W On June 6, 2007, I was at the County of Hawaii Police Department in Hilo with Barbra Tatum Kuikahi, a Kamehameha Schools teacher, where we were bailing out of jail 5 people, including her brother David Tatum and his wife Wendy. I had just helped raise $2,750 for their bail from three different individuals', not including myself. Clifford Dias, who is a St. Joseph Alum and just donated $1,000,000 to the school had offered to put up the bail money but was turned down by Mrs. Kuikahi who he attended St. Joseph with. Mrs. Kuikahi didn't want to impose and she felt that we could raise the money amongst ourselves. I had not been up to David and Wendy's house in over 2 months and had not spoken to them over the phone in this time and was surprised at their house being raided and the police finding marijuana. After meeting the bail bondsmen at the police station and filling out the paperwork for their bail, David and Wendy were than released. While talking to Wendy outside the receiving area, she mentioned someone was taking our picture from the building next door. I turned around and saw from a distance of approximately 40 yards a short, stocky, male individual with a crew-cut hairstyle with a bright yellow "police' shirt taking my picture. I turned and waved and was a little surprised by this. I than went back in to the receiving area and this officer with the yellow t-shirt had come back inside the building and as I looked behind the receiving desk, I could see him watching the monitor intently as everyone was being processed. He would not turn around to acknowledge me or any of us and seemed to be caught up in his own world of spying on us on the monitor. I than went back outside to speak with someone and he came back outside and started taking our pictures again. As he was taking our pictures, the entire time this incident was taking place he was chain smoking cigarettes. Now being a bar owner and knowing the law when it comes to cigarette smoking in a public area, he was supposed to be at least 20 feet away from the entrance to the building which he was not. We make all of our customers that come to Uncle Mikeys smoke outside at least 20 feet from our establishment.. 3 Reef. ~Toarm" Ref. Date. _ APR _L20 - I really started getting very paranoid by this because I did not believe I was breaking the law let alone doing anything wrong at the police station. I than went back in to the building to continue speaking with the bail bonds women and saw this police officer sneak up to the receiving glass to look at who was there and when I looked at him, he tried to turn his back, hide his face, and he than ran back to the other side of the receiving room. At this point, I became very apprehensive and was wanting to leave but decided not to because I was very curious about what was going on. For the next half an hour, with his back to the receiving window, he intently looked at the video monitor and watched everyone being processed. Offc. Tolentino than went over and they both started looking at the camera and Off. Weber than started animatedly gesturing at the video monitor. When I took cash out of my pocket, he started getting excited, pointing at the monitor and writing down notes and continually gesturing at the screen. This went on for about half-an hour. The whole time, he never took his eyes off the monitor and it seemed as if he was focusing on me. When I started spreading the money out in my hands, he really started to get excited practically jumping up and down on the floor. Mind you, I am a nightclub owner and most of our business is in cash and I had taken out money from our door revenue with me in case there was not enough money to bail everyone out. This just continued to be played out with me spreading out the money in my hands and Offc. Weber bouncing up and down like a dog in heat. Everyone was than processed and had walked outside. All 5 people were pretty shaken up and Barbra and I were just trying to provide support and comfort Off. Weber than came outside and stood in the same position he was in earlier when he started taking our pictures. He was chain smoking cigarettes and taking our pictures again and someone said, "look" and there he was for everyone to see. Mrs. Kuikahi was very annoyed about this and decided to walk over and confront him. I decided to follow her over there in case there needed to be a witness and also knowing this officer's reputation for being abusive and volatile. As I followed her over there, and everyone followed me, he looked right at her and with a cocky and surly look, he took her picture with relish. She than said, "Excuse me, but why are you sneaking around and taking our picture." Weber than said "you are in a restricted area" Barbra than said, "this is not a restricted area, I am on the sidewalk." He than said, "Fuck you, bitch. Just get your ass back over there." (Pointing over at the processing building). He than pointed the camera at me and took my picture. I than said, "show a little class and respect, pal. Aunty is a Kamehameha Schools teacher not some ice head you've arrested." He than said, "Keoki, shut your mouth and go back over there." I than said, "you should show a little more respect to people." Barbra than said, "Keoki, forget it, this guy's got issues." He than said, "I'm a police officer and if you don't shut your mouth I'll go back in the building, grab the other officers and they'll pound you and I'll arrest you." This really pissed me off because he was actually going to frame and arrest me for no reason other than for me defending a 56-year-old woman from his verabal and threatened physical abuse. I thought to myself this guy is nothing but a coward. I than said, "go ahead and try, because I already have a lawsuit against the county and police department and if you do, than I'll name you personally in the lawsuit next." I felt I had to say it because it was the only way I figured he would catch himself and "know right from wrong" Then there was an angry confrontation between us. I don't remember everything he said because of my yelling and with his yelling and it was hard to understand everything he said. But, I do remember specific statements that he did make which I am referring to in this report. I told him that the "county tax payers fund the police station and being a tax payer I have every right to be there" and to ask why my picture is being taken and to protect a 56-year old women from his verbal attacks and physical threats.. He than continued to yell, swear, and threaten to have the patrolmen inside the building come outside and "pound me" and than arrest me along with everyone else.. I continued to yell back at him that "I have my federal civil rights and you can't just arrest me for no reason." After I said that he said, "fuck your civil rights, I'm a police officer". With every statement that was either threatening or an issue of police misconduct, he justified his criminal and unethical actions by saying, "I am a police officer." At this point, everyone was so frightened and intimidated by him that they started walking to the parking lot and our vehicles. They were all afraid that he was going to throw them back in jail and Barbra was actually crying because she is not used to being talked to like that. I stayed there questioning Weber and asked him if it was necessary to harass and intimidate these arrestees along with trying to intimidate me and Barbra even after they were all being released on bail. There was no purpose served by any of his actions and all it did was incite me and make Barbra cry. I felt by talking to him and taking the high road, we could come to some king of meeting of the minds and bury the hatchet. He continued to be arrogant and surly and when I asked him why he was smoking cigarettes so close to the building, he said it was because, "I am a police officer.' Which basically means he can break the law and even threaten to frame people because he is a police officer. He than said, "I saw you with all that money in there. Yeah, I saw you." I than said, "I own a business and it's cash from my business". He than said, "yeah, right. It's drug money." I was hurt by this comment and wondered why he was now accusing me of holding drug money when it was just not true. At this point, I felt being diplomatic and cordial was not going to work and as I turned to walk away he said, "Keoki, are those your friends?" When I said, yes. He said, "you have some weird friends." Barbra was very upset about this and I don't understand why she needed to be treated in this way. I could see why Offc. Weber treated me so badly and kept following me inside and outside the building, taking my picture, threatening me physically and also threatening to arrest me all because he was a "police officer". I get picked on a lot by these guys. But, I don't understand why she needed to be treated like this. When I got home, I immediately called Det. Steve Correa and left a message on his office phone at 12:30 a.m. early Thursday morning. I subsequently left three more messages with him and he finally returned my call on Saturday, June 9, 2007 at 8:11 a.m.. Det. Correa is a great guy and is a shining example of the best of the Hawaii County Police Department. I relayed the incident to him and he recommended that I file a complaint with internal affairs. I declined because I believe that is the last thing to do because I would not like to see an officers career hurt by something like this and also because I don't believe internal affairs will hold this officer accountable for his actions. I requested a meeting with Correa, Weber, Mrs. Kuikahi, and myself to clear the air. I wanted to especially confront him on his unethical and criminal behavior on the night in question. Correa said, " It probably won't do any good because he feels he is untouchable because of all the awards that he has won and he treats people like crumbs. He takes things way too personally and I don't think having a meeting with him will do any good because Weber doesn't get it but I will try and set up a meeting. I don't know why he was out there harassing people when they are being bailed out when he should be in his office doing his work. He has no business even being out there." Correa than jokingly said, "I sometimes wonder if he is on something, like crack.". We both laughed. I told Correa I wanted to confront him on his behavior and I will sleep better at night knowing that at least I tried offering him the olive branch. I told Correa about Weber accusing me of holding drug money and Correa was disgusted and surprised, "he said that" and said it's "gee, it's only money". I told Correa that I am afraid because of my confrontation with Weber and the despicable comments he made to me and everyone else that he might try to get a search warrant for my house and try to frame me. Det. Correa said he would not allow that to happen. I asked him if he could promise me that this would not happen. He did. And I believe him. I told him I would still like to set up a meeting. Det. Correa and I talked a few more times after this but he told me he was not able to set up a time to meet. During these meetings over the phone and at Spencer Health and Fitness Gym, I apologized to him because when I see Steve it's always cordial because he is in my opinion one of the nicest guys in the police department. He told me, "don't apologize because I believe everthing you told me is true because I know how he is. I've told him many times he needs to relax and not take things so personally." After giving a statement to Det. Hatton about the incident and deciding to pursue a criminal complaint against Weber, I told Hatton that I wanted to inform and apologize to Det. Correa about pursuing this complaint because I had told him I wasn't at the time, about to pursue a internal affairs complaint. Det. Hatton said he would be willing to relay my message to Det. Correa to call me. Det. Correa called me on approximately 9:10 a.m., on August 20 on Monday morning. I told him I wanted to apologize about pursuing a criminal complaint against one of his men and he said, " don't worry about it Keoki. I spoke with John Weber about a meeting with you, me and him. Just the three of us. I told him we could talk about this and hash it out amongst the three of us and squash it and this issue would go no further. And he said, "Nah". You do what you got to do because I can't help him any more". I than said fine and Steve and I wished each other a good day. I am angry, disgusted and speechless that this arrogant, power-hungry, heartless individual is actually working as a vice officer for the County of Hawaii. This behavior at the Hawaii County Police Department was outrageous and any good-will other officers attempt in the community is wasted when you have policemen acting like bullies and common criminals. I was not in Mountain View when these other allegations, sexual assault of a minor is one of them, supposedly occurred at the Tatum home and can only speak for the incident that happened in Hilo, but I wouldn't be surprised if it did happen when you have brainless animals like Weber supervising a marijuana raid. I suppose all of these incidents occurred on county payroll time, or is it overtime. For him to be harassing Barbra and I on county time is a disgrace and embarrassment to this police department and county. He has no respect and offered no dignity to the people he arrested let alone for a business owner like myself and a Kamehameha Schools kindergarten teacher who are tax paying citizens that were just at the police station to support our loved ones. This officer has no idea of the difference between good people and bad people and that's when no one in this community is considered safe from his actions. First, he started harassing Barbra and I for no reason by taking our picture and spying on us for absolutely no reason. Second, he threatened with physical violence and arrest two innocent people that had nothing to do with this marijuana case all because he wanted to hold his supposed omnipresent power and authority over us. Third, when I attempted to mediate this issue with his supervisor (who wanted to mediate this issue) he refuses to even acknowledge us. This is a dangerous individual and someone that could hurt the reputation of the police department and maliciously destroy lives in our community if he is allowed to continue to operate the way he does. I would be willing to take an FBI administered polygraph test to confirm what happened on that night and would look forward to testifying in court against this person who is supposed to be protecting and serving our community. Officer Weber conducted himself in a disgraceful and intimidating manner while on duty June 6, 2007. Contact with him was made while he stood outside the juvenile pick-up area smoking his cigarettes at the Hilo Police Station. I was there to bail my brother, David Tatum, and the six others that were taken in with him on Monday, June, 4, 2007. As they were coming out from the cell, the bonds person had those sign forms before joining us outside, where the air was warmer. My attention was diverted by the conversation my sister-in- law, Wendy Tatum, and George Kai, Jr., supporting friend had, as they stood outside waiting for the rest to be cleared. They said, "Someone is taking our pictures! I asked who and Wendy responded, "It's the guy that busted us." Rather upset and not wanting them to deal with the emotional strain of talking to Officer Weber. I said, "I'll go and ask what the purpose of taking your pictures is." Officer Weber was standing with foot up on the railing, smoking his cigarettes and taking pictures as I proceeded towards him. I asked, "What is the purpose of taking our pictures? He responds, "Don't come any further....this area is off limits." I pointed out to him that the sign read, "Juvenile pick-up here." His comment was, "Do you have a juvenile?" I said, 'No, so its' not off limits." I continued to proceed towards him by stepping off the curb to make closer visual/audible contact. I again asked him, "What is the purpose of taking our pictures?" His raised voice and response was, "You fucking bitch, your see those officers there, (points to officers in the juvenile pick-up area) you want me to have you arrested?" I asked, "For what?" He replies, "For coming into an off limits area." I again asked the question, "What is the purpose of taking our pictures?" George Kai responded to him that that's not the way to talk to me. I said, "It doesn't matter but this guy has a problem." Officer. Weber knew that the emotional level of those involved were "high". He wanted to feed on this for what reason? To harass, irritate and create a more hostile environment? Therefore, why aggravate the situation but instead keep his "face" out of sight. I'm sure there are other areas where he could have continued his bad habit, cigarettes. Yes, their lives have been shattered by their serious mistake but now let them return home to deal with the imbalance created. Realizing that this man is an insensitive, self-centered, power/control and arrogant individual, our time was more worthwhile getting David and Wendy back to their children. I felt violated, harassed and intimidated being spoken to, by Officer Weber, in this manner and to know that someone has taken my picture without my consent. I hope this complaint will aid Officer Weber in his future approaches to society. Yes, officers are needed to carry on this work BUT once their job is done, so to speak, to carry on the emotional stress, especially as they are released, to me seems uncalled for and definitely out of the line of duty. My sister Barbara Kuikahi could see what he was doing and the way he was doing it, that we were getting upset. Barbara said that she would go talk to him, to see if it was necessary or purpose of taking the pictures. I heard my sister ask Weber in a calm voice and in a nice way about R. I was so happy and sad that tears flowed as 1 held my sister-in-law Barbara Kuikahi. As I walked outside with George Kai Jr. I noticed a flashing light we both turned to look to see what it was. It was John Weber taking a lot of random shots of my family and friends. He did this In a very harassing way. It was as if we were being taunted. This was ridiculous it seemed as if he had taken a few hundred pictures. Barbara seen how he was harassing all of us (the ones being released and the bailing us out) went to ask John why he was taking photos after the fact. Before she could finish asking Weber yelled in a threatening way "YOU FUCKIN BITCH GET THE FUCK OUT OF HERE AND IF YOU DON'T ILL FUCKIN ARREST YOUR FUCKIN ASS YOU BITCHI" She could not believe what she was hearing and the way she was being spoken to for no reason. She turned away from his verbal abuse, flushed red and crying. My husband (David her brother) tried to comfort her from the abuse and threats. Weber then went off on George calling him a "fucker". George asked Weber "Do you know who you are talking to? She is a Kamehameha School teacher. And where is your respect?" Weber said "WHO FUCKIN CARES AND FUCK ALL YOU GUYS." George then replied "We are all citizens." Then Weber said will go and get someone to come down there to buss your fuckin ass and then arrest your fuckin ass." George then replied "we are taxpaying citizens, we help fund this place." Weber then threatened all of us with "ill arrest all of you tuckers right now." at this point 1 could not'endure any more threats and verbal assault I walked away. Weber still swearing threatening and intimidating George and the rest of us. So we left as soon as the process was over. As I walked out the front door, I noticed a Hilo Police Vice Officer John Weber taking pictures of us. Barbara Kuikahi said, "I'll go over there and see what this is about" and George Kai followed her over there. Before they even got over there I could hear him swearing at them. He looked at Barbara and I specifically heard him say, "you better get the fuck out of here bitch before I have you fucken arrested." Barbara than came back crying and Dave Tatum was upset about that and was than trying to comfort her. I than heard Keoki and Weber arguing. I could not hear what Keoki and Weber were arguing about.
