Dear Chair Hoffmann and Members of the County Council:
SUBJECT: CDP IMPLEMENTATION
Thank you for the opportunity to collaborate with you on the establishment of a CDP
implementation body from the community to carry represent the community's interest as
we move forth with the CDP plans. As you know we are in the process of wrapping up
the draft CDPs for Puna, Kona and Kohala so it is timely that we address the question of
who and how the community will remain involved in the implementation of the plans.
We appreciate you initiating the effort with a draft ordinance proposal (dated February 5,
2008) after conversations with me and other staff. Since that time we have conferred with
our staff, the mayor's office, Research & Development staff and others currently
involved in the CDP to obtain feedback since they will be ultimately responsible for
supporting whatever community CDP implementation entity is formed. After
considerable deliberation and discussion, we have drafted an ordinance proposal which is
attached for your consideration.
Below we have listed the key elements of our proposal and the rationale behind it.
1. Ordinance amends Chapter 16, The Hawai'i County General Plan as the CDPs are
"short and middle range" plans that further define the broader goals of the
General Plan. In Sections 1, 2, and 3 we have articulated the relationship of the
CDPs within the context of the broader GP framework and the process for CDP
adoption and amendment. A A

2. Section 4 addresses the details of the "CDP Action Committee" which is so
named to avoid confusion with other councils.
a. We propose a 9 member Action Committee to provide adequate
representation to compensate for inevitable absences.
b. Committee membership terms and broad selection criteria are spelled out
providing flexibility for the individual CDPs to further define.
3. Section 16-6 Duties and responsibilities outlines the nature of the authority and
responsibilities of the Action Committee. The key focus is advisory oversight and
advocacy - providing guidance, community awareness, and partnering with County
government and community-based organizations rather than regulatory. This was
arrived at after considerable debate. We did not want the Action Committee to
duplicate existing regulatory review such as Planning Commission and Board of
Appeals. To make the Action Committee review land use applications that go to the
Planning Commission would create a duplicative layer of government.
The Committee will monitor the effectiveness and progress of CDP implementation
and provide recommendations on the County CIP and operating budgets. They will
also be the community entity to provide input on CDP and GP amendments and
updates.

We look forward to sharing with you the upcoming draft CDPs and assisting in their
adoption.
