The Secretary's Minutes of the Executive Committee Meeting January 21, 1998 were approved and placed on file (Attached for information). The Treasurer report for January 1998 was approved and placed on file (Attached for information). Under NACO Reports, Second Vice President Kouchi reported that NACo is in the black for the first time in years, and that Carol Roberts, from Florida, and Xavier Gonzales, from New Mexico, have both announced their candidacy for NACo 2itl Vice President. Under Unfinished Business, a legislative proposal authorizing the counties to establish a general excise tax of one-half per cent was filed because the Hawaii County Council did not support this proposal. The Executive Committee also deferred action on a resolution proposing a National Policy on Alcohol and Substance Abuse Testing Program and on a HSAC and NACO Statement of values, pending reports from all of the counties. Finally the Executive Committee was advised that the HSAC Year-End Conference is being planned for June 9-10, 1998, on the island of Lanai. The conference theme is tentatively listed as "The Tides Of Change: Reform And Innovation In County Government". Proposed panels are: 0 The Media Tools of a New Generation: Bridging the gap Between People and their Government" 0 Community Planning and Consensus Building: Smart Development 0 Community Planning and Consensus Building: Airport Expansion 0 County Government Structure and Elections: Nonpartisan Elections, Term Limits, Districting voting, Campaign-Finance Reform, and Neighborhoods Boards. James Arakaki, Chairman March 17, 1998 Page 2 Under New Business, the Executive committee referred both the proposed HSAC Annual Budget and a memorandum on the appointment of HSAC Officers for fiscal year 1998-1999 to the County Councils. Since the Hawaii County Council is currently considering the proposed HSAC Annual Budget by separate communication, it needs only to consider the appoint one of its members to serve as an officer of HSAC. It is requested that the Hawaii County Council appointed one of its members to serve as an officer of HSAC for fiscal year 1998-1999. It is further requested that an alternate be also appointed (Attached, action requested). Finally under New Business, the Executive Committee recommended that Hawaii commit to an early endorsement of Xavier Gonzales, Candidate for NACo 2nd Vice President. Members of HSAC who have attended the NACo and WIR Conferences have all had the opportunity to meet both candidates. Members of the Executive Committee have found Xavier to be a better candidate. Further, in keeping with traditional practices, Hawaii has always committed its first round votes to the candidate from a WIR state. The next HSAC Executive Committee Meeting is planned for May 8, 1998. There being no further business, the meeting was adjourned. Attachments Hawaii State Association of Counties Counties of Kauai. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the December 10, 1997 meeting of the HSAC Executive Committee were approved and circulated. III. TREASURER'S REPORTS The Treasurer Reports for the months of November 1997 and December 1997 were approved as circulated. IV. REPORTS A. Executive Committee Report The following Executive Committee Reports were placed on file: 1. An Executive Committee Report on the approval of dividing the duties the HSAC Secretary-Treasurer, and a $1,000 advance to the City and County for the purpose of opening up a Conference Checking Account for the HSAC Mid-Year Conference, were received and placed on file. (Approved on December 10, 1997) B. County Report 1. County Report from James Y. Arakaki, Hawaii County Chair, to President Rene Mansho, dated December 8, 1997, regarding the HSAC Legislative Package and the approval of Honolulu Council Resolution 97-314 supporting the establishment of a nationwide uniform alcohol and substance abuse testing program was placed on file. 2. County Report from Ronald Kouchi, Chair, Public Safety & Services/Intergovemmental Relations Committee, Kauai County, to President Rene Mansho dated December 18, 1997, regarding the HSAC Legislative Package was placed on file. 3. County Report from Donald Ikeda, Hawaii County Clerk, to President Rene Mansho, dated December 10, 1997 transmitting a copy of Resolution No. 188-97, supporting the efforts of the National Association of Counties' Joint Center of Sustainable Communities was placed on file. 2 0 C. NACo Report President Rene Mansho advised the HSAC Executive Committee that Hawaii will have a booth at the NACo Legislative Conference to be held February 27 - March 4, 1998. Counties will be able to promote their islands as pre or post conference destinations for the WIR Conference in Juneau and the Annual Conference in Portland. The next NACo/WIR Board Meeting will be at the Legislative Conference on Sunday afternoon. First Vice President Dennis Nakamura volunteered to be the Legislative Conference Gift Coordinator. Each county needs to provide 24 items for the Aloha Packages. Second Vice-President Ron Kouchi reported that the NACo Board Members were asking for feed back on whether or not the counties have any plans about the millennium. If so, they are interested in hearing the plans because they have a group that is working with the White House in making plans for the millennium. V. UNFINISHED BUSINESS A. HSAC Legislative Package The purpose of this item is to discuss proposals for the 1998 HSAC Legislative Package. Items related to privatization and recreational tort liability were approved for inclusion within the 1998 HSAC package. All other items were deferred pending action by all the counties. B. Privatization The purpose of this item is to act on a resolution requesting the Governor and the State Legislature to give priority attention to addressing and resolving matters relating to privatization. See Honolulu Council Resolution 97-339. This item was approved and will be included with the 1998 HSAC Package. County Taxes The purpose of this item is to discuss a legislative proposal to authorize the counties to establish a general excise tax of one-half percent. See memorandum from Dennis Y. Nakamura, HSAC First Vice President to President Mansho, dated January 12, 1998, related to HB 94 (1997). This matter was deferred pending official action by county councils. D. HSAC Legislative Policy Statement The purpose of this item is to act on a draft of the 1998 HSAC Legislative Program Policy Statement. The approved Policy Statement differs from that initially recommended by the HSAC President. The Honolulu Council deleted provisions which authorized testimony by the HSAC President or Executive Committee on other measures which impact the counties without prior approval of the councils. All four counties have reported approval of the 1998 HSAC Legislative Program Policy Statement. The initial version of the Policy Statement was approved by Kauai and Hawaii in November 1977. The Oahu City Council approved the amended version on 12/3/97. Maui County approved the initial version on 1/16/98. E. United States Air Rights Negotiations The purpose of this item is to act on HSAC's proposal to support Honolulu Council Resolution 97-126, CD1, urging the United States Department of Transportation to recognize Hawaii's geographic constraints during air rights negotiations. Statewide Uniform Alcohol and Substance Abuse Testing Policy The purpose of this item is to act on a resolution urging the Governor and the four counties of the State to collectively establish a statewide uniform alcohol and substance abuse testing policy. See Honolulu Council Resolution 97-255. All counties report approval of this matter. Hawaii - Approved 10/1/97 Kauai - Approved 9/24/97 Maui -Approved 1/16/98 Oahu - Approved 9/24/97 G. National Policy on Alcohol and Substance Abuse Testing Program The purpose of this item is to act on a resolution urging the President of the United States and the members of the U.S. Congress to establish a nationwide uniform alcohol and substance abuse testing policy. See Honolulu Council Resolution 97-314. This matter has been deferred pending official action by Kauai and Maui Counties. H. HSAC and NACo Statement of Values The purpose of this item is to act on the proposed HSAC and NACo Statement of Values. See Honolulu Council Resolution 97-373. This item has been deferred pending official action by Hawaii, Maui, and Oahu Counties. 1. HSAC End of-Year Conference (Maui County) The purpose of this item is to discuss the planning of the HSAC End-Of-Year Conference (theme and location will be announced at a later date). The conference will be held June 9-10, 1998 on Maui. VI. NEW BUSINESS There was no discussion on new business items. A. United Nations Protocol on Global Warming The purpose of this item is to act on a resolution expressing opposition to the recently adopted United Nations protocol on global warming. 5 B. Environmental Protection Agency Standards on Ozone and Particulate Matter The purpose of this item is to act on a resolution expressing opposition to the Environmental Protection Agency's newly adopted standards on ozone and particulate matter. VII. COMMUNICATIONS There were no communications. VIII. ANNOUNCEMENTS The HSAC Executive Committee would like to meet on the fourth Friday of each month. Counties will be submitting their calendars to Andrew Sekine at Honolulu Council to organize HSAC Meetings. The next meeting will be announced at a later date. IX. ADJOURNMENT There being no further business, the meeting of the Executive Committee was adjourned at 9:27 a.m. Very Truly Yours, AL SMITH Secretary-Treasurer Hawaii State Association of Counties 6 e • e • President Rene Mansho announced that at the legislature meeting on January 20, 1998, the following issues were brought up. A presentation by all four mayors was given on the TAT. Maui County was the only one volunteering to give away their 20% to support the promotion of the tourism industry. All other mayors were saying they wanted to keep the existing formula. The legislature is asking for a county consensus to be unified on certain issues. We do have consensus from the mayors as far as the privatization issue. Collective bargaining is an issue that we need to bring up to our county councils. Rene will draft it and it will be discussed at a future meeting. Vacations should not be given automatically when you start, that you should work one year and then get it. Health benefit packages are expensive for the family packet and we're not hiring the entire family, therefore the benefits should go to the employee and not the whole family. Abolishing the land use commission and water commission. All four mayors were very consistent in that. Mayor Harris had proposed the duplication issue on roads and parks that the City and County of Honolulu could be absorbing those so you would only have one parks dept., one roads/highways dept. Mayor Kusaka is asking for zero tolerance in the work place. This is something that all county councils could discuss. It would become a collective bargaining issue. Discussions in the Legislature was also performance based budgeting. Each council shall also appoint an alternate. To ensure that the slate of appointees is authorized in a timely manner, I request that you initiate procedures to appoint a council member to serve on the HSAC executive committee prior to the next HSAC executive committee meeting, tentatively set for March 13.
