Dear Ms. Towle:
Re: Spay-Neuter Contract Requirement.
This is in response to your request concerning the
spay-neuter agreement which the-West Hawaii Humane Society
requires as a condition to adoption of a dog or cat.
Pursuant to §143-8, HRS, the Humane Society may require
that dogs be neutered as a condition of giving them to people.
Therefore, it would be proper to cite people who fail to carry
out the spay-neuter agreement as being in violation of §143-8.
This would be authorized by §143-19, HRS. However, it must be
pointed out that §143-8 allows the Humane Society to require
neutering of dogs only. This would mean that a violation of the
spay-neuter agreement would only be subject to citation if it
involved someone receiving a dog and not for someone receiving a
cat.
In view of the above, it may be useful for you to contact
members of the state legislature or the county council about the
possible amendment of the state law or the passage of a county
orainance to clarify the present situation.
