Arakaki, Chairman and Members of the County Council County of Hawaii 25 Aupuni Street Hilo, HI 96720 Dear Chairman Arakaki and Members: Initiator: Planning Director Proposed Bill to Amend the County of Hawaii General Plan, Section 6 of Ordinance No. 89 142, as Amended by Ordinance No. 90 71 Relating to General Plan Amendment Procedures The Planning Commission at its duly held public hearing on January 16, 1998, voted to forward a favorable recommendation on the proposed amendment to the County of Hawaii General Plan, Section 6 of Ordinance No. 89 142, as amended by Ordinance No. 90 71, relating to the General Plan amendment procedures. The purpose of this bill is to make the amendment procedures more understandable and also to amend the procedures to make it consistent with the County Charter. We have enclosed, for your favorable consideration, the amendment(Draft 2) as well as a copy of the staff Background Report for your information. The County Charter states that only the County Council and the Planning Director are able to initiate amendments to the General Plan, while the General Plan states that the County Council, Planning Director, and members of the general public may propose or initiate General Plan amendments. The purpose of [his bill is to make the amendment procedures more understandable and also to amend the procedures to make it consistent with the County Charter. Section 3-15(c). General Plan, of the County Charter states "Amendments to the general plan may be initiated by the council or the planning director." Section A of the proposed bill provides the review and procedures for the Planning Director to initiate a comprehensive review of the General Plan. The procedure includes giving notice of the comprehensive review to the County Council, Planning Commission and the general public. Section B provides the procedures for Interim Amendments to the General Plan by the County Council and Planning Director. This section also provides the procedure on how the general public may submit a petition requesting the Planning Director to initiate an amendment to the General Plan as well as the review and procedure to process the petition.
