Dear Mr. Arakaki,
I am writing you in regards to property which my aunt and uncle, Mae and Henry
Fukuda, and I own in a subdivision called Royal Gardens. I had originally written to Mr.
Gary Kiyota, Real Property Tax Administrator for the County of Hawaii, who advised me
back in 1996 of three alternatives to dispose of this property, which we desire to do. As
you know, this area is of no value at present as it is overrun by lava. The three
alternatives are as follows: 1) gifting the property to the County of Hawaii, thus
transferring our interest in the property to the County by way of a quitclaim deed;
2)seeking assistance of a licensed realtor to sell the property; 3)abandon the property. He
advised me to try and sell the property as there had been an interested buyer in the past. I
did seek a realtor's help, and there has been no interest in the property.
On February 9, 1998,1 spoke with Mr. Ivan Torigoe, Corporation Counsel, who
explained to me that the County Council is at a standstill regarding gifting back property
to the Big Island of Hawaii. As I understand it, we no longer have this option. If we
abandon the property and not pay taxes on it, we may be held liable for payment of back
taxes. The property is of no use, and although we wish to be rid of it, we are stuck with
it, and must continue to pay taxes on it. Can you help us resolve this problem?
