Chapter 3, Eiawai'i County Sign Code
Attached please find Drag 2 of Bi11280 regarding the County Sign Code.
This proposed draft contains a number of substantive changes to address certain major concerns
which consistently surfaced during public hearings and testimony. In addition, a number of less
substantive revisions are proposed to further clarify definitions and other sections of the bill.
It is believed that the adoption of these amendments will address these concerns and further
improve and strengthen the bill, thus making it more effective.
In the interest of providang a-wick reference and in keeping with the format for previous drafts, I
have also attached atwo-page summary of the proposed amendments.
Please circulate this letter and the attachments to all council members prior to the September 2
council meeting.

Secti®n 3-3 Definitions ®f ~~sign~' and types ®f signs.
Refines and adds definitions for aerial, automated, window, wall, portable, and painted window
signs and banners. Generally taken from the model sign code.
Section 3-4 general defeniti®ns.
Modifies the definition of street (to conform with model code).
Section 3-5 Size of Signs
(a) (3) Modifies for clarity
Secti®n 3-7 'Tylae, l~iunnber, and Size ®f Signs
(b) Modifies to permit only one ground sign per lot, rather than per business, for lots with
multiple businesses (as example, Crossroads Shopping Center). Also clarifies that allowance is
based on adjacent dedicated streets.
Section 3-g Signs pr®hibited in all districts
Modifies to prohibit roof signs, automated signs, aerial signs, portable signs, "temporary" signs
used for ongoing commercial advertising (i.e. sandwich boards or permanent banners), and signs
on utility poles.
Section 3-'~ Exegnnpt signs.
Modifies to allow only the following signs to be exempt from getting a permit: real estate signs
within new specified size lianits, small signs not exceeding two square feet for athirty-day
period, signs of a public nature as in original ordinance, temporary signs not displayed more than
7 days per year. Requires that temporary signs be removed within 48 hours following
completion of event or activity (for real estate, that would be close of escrow).
N.B.: may be considered content-based.
Section 3-10 Signs allowed with perreaits, in all districts
Refines description of temporary signs or banners permitted and requires a "remove by" time,
adds signs which were previously considered exempt from the permitting process, including
announcing signs, subdivision improvement signs, and signs describing the name of public,
charitable, non-profit, or religious institutions.
N.13.: may be considered content-based.
Section 3-12 Sigaas permitted in all other districts.
(1) Ground Sign: refines ground sign requirements that scales size and height of sign permitted
to lineal frontage of lot, with 3 categories, allowing a 16 square foot sign 8 feet high, a 24 square
foot sign 12 feet high, or a 32 square foot sign 16 feet high, to provide appropriate scale.
(2) Marquee Sign: reduces size allowed from 250 square feet to 60 square feet; maximum letter
height not to exceed 24" .
(3) Projecting sign: reduces size allowed from 32 square feet to 16 square feet; prohibits
extending above the building.
(5) dVall Sign: (13) Refines wall sign size to a maximum of 10% of wall area, or 32 square feet;
(C} Reduces wall sign size to a maximum 15% or 150 square feet. Notes that painted window
signs are considered one type of wall sign.
(6) Window Signs: allows window signs or painted window signs to cover an area of no more
than 25% of total window area (same as ICailua Village)
Section 3-33 Height above buildangs:
Requires that sign not extend above building.
Section 3-35 Signs erected pri®r to the e#~ective date of this chapter:
Allows nonconforming signs for a period of 36 months following effective date.
Secti®n 3-35 Penalty:
Fine is $100 per day instead of"up to $500."
Secti®r~ 3-47 Educational material
New provision; requires issuance of a brochure/pamphlet to assist with public understanding and
easy use of revised ordinance.
