Your cost share by prior Agreement, using the contractor's unit prices is seventy one-thousand, four hundred thirteen dollars and fifty cents ($71,413.50). The following is a breakdown of your cost, based on the construction's project agreement. Traffic Signal System (nonpar) $ 44,980.00 Water System (nonpar) $ 14,518.50 Highway Lighting System (nonpar) $ 2,600.00 Engineering & Design Construction Administration & Engineering (15%) $ 9,315.00 TOTAL $ 71,413.50 Your cost may increase or decrease from any necessary adjustments made in the actual construction of your facilities. We will make a final adjustment at the end of the project. Akinaka & Associates, Ltd. r COST SHARING AGREEMENT THIS AGREEMENT made this ~ day of 1rb-_4 1997, by and between the COUNTY OF HAWAII, hereinafter "County" and RICHARD SMART REVOCABLE PERSONAL TRUST, hereinafter "Parker Ranch," whose business address is 67-1185 Mamalahoa Highway, Kamuela, Hawaii, and whose mailing address is P. O. Box 458, Kamuela, Hawaii 96743; Witnesseth That: WHEREAS, Parker Ranch has requested that a traffic signal system be installed at the Puukalani Street and Mamalahoa Highway intersection, for its benefit; and WHEREAS, Parker Ranch has also requested that a waterline system upgrade be made at that intersection; and WHEREAS, the County of Hawaii will install the Mamalahoa Highway improvements, which include the traffic signal and waterline system upgrade at Puukalani Street and Mamalahoa Highway (Kamamalu Street to Lindsey Road), County of Hawaii Job No. P-3257, FAP No. STP-019-1(24); and WHEREAS, Parker Ranch has agreed to pay for twenty-five percent (25%) of the cost of the traffic signal improvements, which were placed for its benefit; and WHEREAS, Parker Ranch has agreed to pay for one hundred percent (100%) of the water system upgrade, which were placed for its benefit; NOW, THEREFORE, BE IT AGREED THAT: 1. The County of Hawaii will construct a traffic signal system at Puukalani Street and Mamalahoa Highway intersection. 2. The County of Hawaii will construct a waterline system upgrade for Parker Ranch at that intersection. 3. Parker Ranch shall pay for twenty-five percent (25%) of the traffic signal system. 4. Parker Ranch shall pay for one hundred percent (100%) of the waterline system upgrade at the intersection. 5. The construction costs shall include, but not be limited to, engineering, design, construction administration, and construction engineering, in additional to actual construction. 6. These costs may also be subject to lump-sum payments or change orders with which Parker Ranch will be provided a copy of. 7. The County of Hawaii will bill Parker Ranch for the sum, and Parker Ranch shall remit payment to the County of Hawaii within sixty (60) days of the billing date. 8. If Parker Ranch does not remit payment on a timely basis, the County of Hawaii may attach a lien on Tax Map Key No. (3)6-7-02:017, which is the adjoining parcel that is benefitting -2- from the operation of the traffic signal system and the waterline system upgrade. KECK OBSERVATORY, doing business as the California Association for Research in Astronomy (CARA), whose business and mailing address is 65-1120 Mamalahoa Highway, Kamuela, Hawaii 96743; Wi nesseth That: WHEREAS, CARA has requested that their west driveway be redesigned and constructed at the Mamalahoa Highway intersection, for its benefit; and WHEREAS, the County of Hawaii will redesign and construct the Mamalahoa Highway improvements, which include the west driveway reconstruction as requested by CARA for the Mamalahoa Highway (Kamamalu Street to Lindsey Road), County of Hawaii Job No. P-3257, FAP No. STP-019-1(24); and WHEREAS, CARA has agreed to pay for the west driveway redesign and construction, located along the Mamalahoa Highway, which was placed for its benefit; NOW, THEREFORE, BE IT AGREED THAT: 1. The County of Hawaii will reconstruct the west driveway for CARA along the Mamalahoa Highway. 2. CARA shall pay for one hundred percent (100%) of the west driveway redesign and construction. 3. The construction costs shall include, but not be limited to, engineering, design, construction administration, and construction engineering, in additional to actual construction. 4. These costs may also be subject to lump-sum payments or change orders with which CARA will be provided a copy of. 5. The County of Hawaii will bill CARA for the sum, and CARA shall remit payment to the County of Hawaii within sixty (60) days of the billing date. 6. If CARA does not remit payment on a timely basis, the County of Hawaii may attach a lien on Tax Map Key No. (3)6-5-04:014, which is the parcel that is benefiting from the use of the west driveway construction.
