THROUGH LEASE, EXCHANGE, AND SALE. WHEREAS, in 1994, the Council of the County of Hawaii agreed to accept approximately 4,400 acres of land by Commissioner's Quitclaim Deed as a settlement for retroactive real property taxes among Western Farm Credit Bank, the County of Hawaii and Hamakua Sugar Company, Inc.; and WHEREAS, on May 1, 1998, the Mayor forwarded to the Council Resolution No. 267- 98, which approves a disposition plan that proposes land exchange with private landowners on a value-for-value basis in order to expand or improve the Hoolulu Park Complex, Kahaluu Beach Park parking, Honolii Beach Park, Ahalanui Park and other lands as they may become available or may be necessary; and WHEREAS, on August l7, 1998, Council Member Dominic Yagong forwarded to the Council Resolution No. 309-98, which authorizes the leasing of County lands for diversified agricultural, eco-tourism and pastoral uses by negotiations; and WHEREAS, on August 27 and 28, 1998, the Council's Finance Committee held public hearings on Resolution Nos. 267-98 and 309-98 in Captain Cook, Kona and Hamakua, respectively; and WHEREAS, written and oral public testimony received by the Finance Committee supported an array of disposition methods, including sale of County parcels; lease of County lands for a variety of purposes; exchange of County parcels for purposes proposed in Resolution No. 267-98, and sub-lease to the State of Hawaii for agricultural purposes; and WHEREAS, Council Member John Ray presented a compromise resolution by amending Resolution No. 267-98 with Draft 2 which would incorporate avenues of land disposition as allowed in Chapter 2, Article 19, Section 1-112; 2-113; 2-114; and 2-(15 of the Hawaii County Code; and WHEREAS, the subject Resolution No. 332-98 meets the intent of Resolution No. 267- 98 Draft 2, and identifies lands in Exhibit A as necessary to protect our prime lands for diversified agricultural, eco-tourism and pastoral uses, and enhances the viability of creating a commercial agriculture industry in Hamakua; and WHEREAS, the Council wishes to provide a clear directive to the Mayor for disposition of certain lands, while allowing administrative flexibility on the avenue of which to dispose of said lands; and WHEREAS, the combined leasing, sale, and exchange of the 4,400+ acres of said lands will create revenues for the County of Hawaii in the form of real property taxes and lease payments. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that based upon all of the above consideration, the public interest demands the leasing or sub-leasing of 2016+_ acres of County lands as delineated in Exhibit A for diversified agriculture, eco-tourism and pastoral uses through negotiations, sealed bids or auction. BE IT FURTHER RESOLVED that it authorizes the finance director, pursuant to the requirements set forth in Chapter, Article 19 of the Hawaii County Code, to proceed with the disposition of 2,016+ acres of land identified in Exhibit A by leasing or sub-leasing for diversified agriculture, eco-tourism and pastoral uses through negotiation, sealed bids or auction. BE IT FURTHER RESOLVED that it authorizes the finance director, pursuant to the requirements set forth in Chapter 2, Article 19 of the Hawaii County Code, to proceed with the disposition of the remaining 2,400+ acres of land identified in Exhibit B in the following manner: 1. Leasing or sub-lease a portion of these lands for diversified agriculture, eco- tourism and pastoral uses through negotiations, sealed bids or auction. 2. Exchange a portion of these lands on avalue-for-value basis for purposes of expanding existing County-priority parks, roads, water projects or other infrastructural systems or facilities. 3. Sell a portion of these lands through auction, sealed bids or negotiations. BE IT FURTHER RESOLVED that a report of disposition be forwarded to the Council upon completion of the negotiation, exchange, and sale of County lands. BE IT FINALLY RESOLVED that copies of this resolution be transmitted to the Honorable Stephen K. Yamashiro, Mayor of the County of Hawaii and the Director of Finance.
