Suite 325 Hilo, Hawaii 96720 Dear Mr. Wurdeman: RE: COUNTY JURISDICTION ON HAWAIIAN HOME LANDS Recently, your office provided Opinion No. 98-02 regarding the extent of County authority over lands under the jurisdiction of the Department of Havvaiiau Home Lands (DHHL). Specifically, Section 3, Sewer Fees states: The Act does not address sewer systems, but since sewer fees are assessed to promote the health and welfare of the communih- and, since they do not control the manner in which DHHL lands are to be used, neither are they adverse to the purpose of the Act; appropriate sewer fees may be assessed against uses of that service. According to this statement, are w e to assume that those persons livi=ng on DHHL lands are obligated to hook up and pay sewer connection charges for land that they lease? Curtis Tyler a Member, Hawaii County Council 25 Aupum Street Hilo, Hawaii 96720 RE: COUNTY JURISDICTION ON HAWAIIAN HOME LANDS Dear Mr. Tyler: You have requested my comments on the question of whether sewer charges are assessable on lands under the jurisdiction of the Department of Hawaiian Home Lands (DHHL). As you point out in Opinion 98/02,1 concluded that since sewer charges do not affect the use of land, they may normally be assessed against DHHL, Lessees. I am aware that, it has been alleged that the previous Chief of the Waste Water Division made some unauthorized statements to residents of Kea ukaha to the contrary. Without further substantiation of what the details of those statements were, I continue to maintain that the Keaukaha residents axe subject to the same c1wrgcs as other citizens. Sincerelv. CHARD D.
