Fischler, at Ouli, South Kohala, Hawaii TMK: 6-2-I 1:25, reports as follows: Bill No. 17 amends the State Land Use Boundaries Map, I I-Id, by changing the district classification for approximately 5.0005 acres of land Irom an Agricultural to a Rural zoned district. Bill No. 17 was lirst agendized on .lanuary 7, 2003, but was deterred until today because the applicants representative was not able to attend the meeting. The rectangular-shaped subject property. owned in fee by Robert D. and Deborah n. Fischler, and .lohn and .Iulie Oakland under a Condominium Property Regime. is located in the Anekona Estates Subdivision at the southwest side of the Anekona Street-Kanchoa Street intersection. On June 22. 1998, the State Real Estate Commission reported that the property is a Condominium Property Regime. Che applicant proposes to subdivide the property into two lots, 2.6402 acres and 2.3603 acres in size, to establish separate fee ownership and dissolve the Condominium Property Regime..lohn and Julie Oakland occupy the dwelling located on the proposed 2.3603 acre lot which was constructed in 2000. The LUPAG map designation is Extensive Agriculturah which allows uses for pasturage and range lands. In 1967, with the adoption of the Zoning Code, the property and surrounding areas were zoned Unplanned, where no sufticient studies were conducted to adopt specitic district classification. When the 7.oning Code was adopted in 1996, all Unplanned coned districts were reclassified to agricultural -5 acres. Under the proposed State Land Use Rural District and RA- 2a zoning, ohana dwellings are permissible. I~he property is not located within the Special Management Area_ as it lies approximately 6 miles ti-om the nearest coastline. Adjacent lands to the south have recently been designated as Rural and Residential-Agricultural. Parcels to the west, north and cast are still designated as Agricultural, and are used for residential purposes or are currently vacant. Communication 46 Bill 17 Page 2 Surrounding lands are located within the State's Agricultural and Rural Districts and the County's A-Sa and RA-2a zoned districts. In addition to the above. the ten-lot Kamuela Plantations Subdivision lies further to the east, and the 26-lot Waimea Landmark Estates Subdivision lies across Kawaihae Road and further to the northeast. 'These subdivisions include mixed residential uses, vacant lands and very few residential/agricultw~al uses. The 3 ~ unitOuli Ekahi affordable rental housing project and the 40 IotOuli Mutual Self Hclp Housing subdivision are located to the west of Anekona [?states Subdivision. The Hale Wailani Subdivision, located west of Anekona Estates and adjacent to the housing projects is currently zoned A-1 a and the developer proposes a 49-lot subdivision consisting of lots with a minimum size of two acres. The property is located within "bone X, an area determined to be outside the 500-year hood plain. Access to the subject property will be from the Kawaihae Road via Anekona Street with direct access from Kanehoa Street_ a connector road into the adjacent Kanehoa Subdivision. Your Chair explained that this zoning is similar to others we have approved in the past. Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director fbr recommending a favorable consideration for the State Land Use Boundary Amendment request. The change of zone request will result in an appropriate land use pattern that will further benefit the public.
