ON PLANNING DATF,: January 22, 2003 RE: C-96/Bill No. 39 PLACE: Councilroom "TIME: 2:1A p.m. Chair and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning. to which was referred Bill No. 39 transmitted jointly with Bill No. 38, by Mayor Hurry Kim per Communication No. 96, dated December 31.2002. regarding the change of zone request by Walter and Susan Welton, at Hienaloli 2°`~ 3`~ and 4th, North Kona, I lawai'i 'T~MK: 7-5-10: portion of 52 and portion of6~. reports as Iollows: Bill No. 39 amends Section 25-8-3 (North Kona lone Map), Article 8. Chapter 2i (zoning Code) of the Hawaii County ('ode, by changing the district classif ication for approximately 10.02 acres of land from an Agricuhural (A-Sa) to a Single Family Residential (KS-20) zoned district. The somewhat trapezoidal-shaped subject property, owned in Ice by the applicants and CL&D One, LLC, is located adjacent to Kealoha and Kona Heights Subdivisions at the north end of Mclelina Street, approximately a half mile east of the Queen Kaahumanu E lighway Extension. I also lies south and adjacent to the bend in the Hienaloli Drainage Way. The Weltons own Lot 4 of Portion ~2 and 65, which is 8.971 acres in size, and CL&D One, I.LC owns Lot S of Portion 52 and 65, which is 6.063 acres in size. Lots 4 and 5 were created in a previous subdivision action, which was approved in January 2002. Under SUB 7434, approximately 51 acres were divided into 6 lots ranging from 14.533 awes to 5.386 acres in size. fhe applicant would like to subdivide the property into 17 single Iamily residential parcels each consisting of approximately 20,000 square feet. They also plan to prohibit Ohana dwellings. and install underground utilities. The accompanying SLU boundary amendment will be from an Agricultural to an Urban zoned district. "hhe General Plan designation is for Urban 1?xpansion, which allows for a mix of high density, medium density, low density, industrial and/or open designations where new settlements may be desirable, but where the specific settlement pattern and mix of uses have not yet been determined. The Kona Regional Plan encourages residential uses up to a maximum density of4 units per acre. The subject property is located outside the study area of theKeahole to Kailua Development Plan. and the Master Plan fbr Kailua Kona. The property is not located within the Special Management Area. There are several developed residential subdivisions immediately south and west of the subject property. Properties immediately to the cast and north arc zoned A-5a and A-1 a. The U S Soil Survey classifies soils as Punalu'u extremely rocky peat with rapid permeability. slow runoff, and slight erosion hazard_ which is used for pasture. 'fhc Land Study Bureau classifies the soils as "D" or "Poor". hhe majority of the subject property is located in/.one "X°_ an area determined to be outside the 500-year Flood plain. Approximately 8.000 square feet of the northeastern tip of proposed Lot 4 lies in the AE flood zone, which corresponds to the one-hundred year 1loodplain. An archaeological inventory survey and mitigation plan was completed ibr the subject property by Haun and Associates who identified 22 sites of which 17 wero assessed solely for intbrmation content with no further work or preservation recommended. The five remaining sites were recommended for data recovery, and are not located on the properties Ihat are subject to this change of zone application. Due to the grubbing of the subject property in the past, there arc no known native fauna or Mora or archaeological. cultural or historic sites on the subject property. A condition will he included to require notification of the Department of Land and Natural Resources - f f istoric Presen anon Division, should any archaeological sites he encountered during the course of devclopmcnt. Access to the subject property is from Mclelina Street which connects to Nani Kailua Drive via Queen Kaahumanu Highway. Mclelina Street is a 50 foot wide County road with an approximate 36 foot wide pavement with concrete curbs. gutters and sidcv<~alks. Water can be made available to the site from an existing County water system in the Kona Heights Subdivision. Wastewater will be treated in individual wastewater systems approved by the Department of Health . All other utilities and services arc or will he available to the subject property. Bill No. 39, Draft 2, which includes the fair share contributions, was circulated and approved by Your Committee. Committee Member Curtis l~yler explained that there were opposing concerns from the public in regard to this measure because of the assumed traffic speed and noise which will occur as a result of the completion of this subdivision. 'there were also concerns about flooding due to the location of the project site in comparison to the Hienaloli flood channel. Your Committee was assured that all improvements will be done in the "X" area. Your Committee did not entertain further discussion on this measure. Communication 96 Bill 39 Page 3 Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request, which would result in an appropriate land use pattern that will further benefit the public. Your Committee on Planning is in accord with the intent and purpose of BiII No. 39, Draft ?, and recommends it pass lust reading.
