Your Committee on Planning, to which was referred Bill No. ~12, transmitted jointly with
Bill No. 4l by Mayor Harry Kim per Communication No. 98, dated December 31.2002,
regarding the change of zone request by Dennis Young, at Kalaoa 4`~'. North Kona_ Hawaii
TMK: 7-3-10: 29, reports as follows:
Bill No. 42 amends Section 25-8-3(North Kona Zone Map). Article 8, Chapter 25 (7,oning Code)
of the Hawaii County Code, by changing the district classification for approximately 8.256 acres
of land from an Agricultural (A-5a) to a Single Family Residential (RS-15) zoned district.
The irregular-shaped subject property, owned in fee by the applicant and Della deRochemont. is
located west of Mamalahoa Highway at the north end ofAhiahi Street. and bordered by Kona
Coastview Subdivision to the north and Kona Palisades Subdivision to the south.
hhe applicant is seeking to subdivide the property into six lots ranging in size li-om 15.000
square tee to approximately 1.5 acres. All six lots will have access through an extension of
Ahiahi Street to the adjoining Kona Palisades Subdivision located to the south. The extension of
Ahiahi Street will be privately maintained with 16 feet of pavement and 2 foot wide shoulders
within a 50 foot wide right-oi~-way. I f required to be dedicated by the County, the cost of these
roadways shall be credited to the applicanCs fair share assessment. When the lots arc sold. the
deed covenants will include language prohibiting the construction of ohana dwellings.
hhe current State Land Use designation is Agricultural. and the applicant is seeking to change it
to Urban. 'The I.UPAG Map designation is Urban lxpansion, which allows a mix of high
density, medium density. low density, industrial and/or open designations in areas where new
settlements may be desirable, but where the specific settlement pattern and mix of uses have not
vet been determined.
Under the Keahole to Kailua Development Plan. the project site and its surrounding area arc
identitied as an existing residential area which is included in the Residential Expansion area.
the Kona Regional Plan recommends the project area ibr residential uses at a density of tinir
units per acre. 'this recommended land use is consistent with a cw'rcnt RS-10 zoning
designation, a higher density than what is being requested.
hhe property is not situated within the Special Management Area. It is located approximately
three miles from the nearest coastline.

Soils within the project site are not classified on the ALISH map. The Land Study Bureau's
Detailed Land Classification system designates the land as "E" or "Very Poor".
The USDA classifies the soils as Kaimu and Punaluu. The Kaimu is extremely stony peat with
rapid permeability, slow runoff. and slight erosion hazard. 'I~he Punaluu is extremely rocky peat
underlain by pahoehoe with very slow permeability, slow runoff and slight erosion hazard.
'T'he subject property is located in 'Lone "X'~, an area determined to be outside the 500-~ car flood
plain.
Because the subject site was bulldozed previously and improved with two single family
dwellings and agricultural buildings. there are no known native fauna or Mora or archaeological.
cultural or historic sites on the subject property. An archaeological inventory survey was
conducted by Haun and Associates and all of the noted sites are tentatively assessed as important
solely for their information content and no further archaeological work or preservation is
recommended. A condition will be included to require notification of the Department of Land
and Natural Resources -Historic Preservation Division, should any archaeological sites be
encountered during the course of development.
Access to the subject property will be from Ahiahi Street. The applicant's original intentions
were to build this extension to private roadway standards, but the Planning Director
recommended that it be built to County~ledicable standards and dedicated to the County prior to
the issuance of Final Subdivision Approval.
Water can be made available from an existing 6-inch waterline along Ahiahi Street.
Since there is no municipal sewer system in the area. the applicant proposes to dispose ofsewage
via wastewater treatment systems approved by the State Department of Health.
NI other utilities and services are or will be available to the subject propert}.
Bill No. 42, Draft 2, which includes the fair share contributions, was circulated and approved by
Your Committee.
Your Committee did not entertain any discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request. which would result in an
appropriate land use pattern that will further benefit the public.
