Your Committee on Finance. to which was refcired Resolution No. 17-03, reports as fi~llows:
Resolution No. 17-03, transmitted jointly with Bill No. 13 by Director of Finance
William Takaba, via Communication No. 29, dated December 4.2002 authorizes the acceptance
of funds from 'f-Mobile Wireless Services. Inc (fM). for the payment of the costs of
construction of a replacement radio system for the I lawai'i County Police Deparunent
~x1.o64.332.~~>.
The County of I fawai'i holds Fixed Mixed Microwave Services licenses issued by the I~cdcral
Communications Commission (PC(`) for three 2 GHz Microwave Paths located, in whole or in
part, in the 2 GHz Band. The County operates a microwave communications system on the
Affected Paths utilizing 2 GHz microwave equipment which facilities operate within the
coordination distance specified by the FCC` with respect to the "I~M System in the Basic lYading
Area (B'LA).
TM has determined that the 3 GHz microwave equipment may cause interference to the TM
System in the BTA. As a result, TM wants the County to voluntarily and permanently cancel.
delete, discontinue, decommission, surrender and terminate its licenses and operating aud~ority.
which would terminate the County's right to use the Affected Paths.
TM has agreed to pay $1,064,333.16 to reimburse the County for the cost of constructing the
police radio replacement system.
Pursuant to Article X111. Section 13-12. Hawaii County Charter, the Council on behalf of the
County, may accept gifts of donations of money, securities or other personal property or of real
estate or anv interest in real estate.
Originally heard on December 17. 2002. this measure was deferred due to the lateness of the
Committee meeting and. therefore, the inability of the Policc Department to return to the
meeting.
