Communication No. 89 dated December 26, 2003, amends ('hapter 21-36.1 of the Hawaii County Code
1983 (1995 Edition), relating to wastewater service charge rates.
Bill No. 37 proposes revised sewer rates Ibr the County by repealing in its entirety. Chapter 21,
Article 4, Section 21-36.1 of the }lawai' i County Code and adding a new Section 21-36.1. 'I~he
proposed rate increase will he effective as follows:

Since FY 99-00, the Wastewater Division has been required by the HPA Grant conditions that they fund
all operating cost including operation, maintenance, replacement and administration expenses
exclusively through user tees. The current user fees arc based on Uie assumption that the administration
portion of the operating budget would he funded through the General Fund. The proposed increase, it
effectuated, is anticipated to generate an additional $224A67 for FY 2003-04.
Originally heard on January 22.2003, this measure was deterred because the Environmental
Management Director was unable to attend the Finance meeting due to a scheduled Environmental
Management Commission meeting.
Bill No. 37, Draft 2, transmitted by Finance Chairman Aaron S.Y. ('hung, via Communication No. 89.1
dated January 21.2003, amends this measure with the proper ramseyer format.
Your Committee heard testimony in opposition to the measure from Michael I.. I.ast_ (iahriel Manning
of Waiakea I lousebts, and .lohn Ota. Jay West and E lugh Ono of the Environmental Management
Commission testitied in favor of Bill No. 37.
Some members of Your Committee fell that the replacement and maintenance costs should be
subsidized by the general fund since all citizens benetit form dean water.
For informational purposes. Mr. Tyler voted "kanalua" then "no."
A motion to approve was made and seconded, followed by a vote by the eight members in attendance.
The final vote, as reflected blow, prompted the Committee Chair ro forward this measure to full
Council with a negative recommendation.
