Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 72 and attached Resolution No. 31-03, reports as billows:
Communication No. 72 dated December 26.2002, from Assistant Corporation Counsel Gerald'I'akasc
transmits Resolution No. 31-03 for die Council's review and also requests this matter be discussed in
Executive Session.
l~he purpose of Resolution 31-03 is to authorize the acquisition of private property by eminent domain-
I'he subject parcel is identified as a portion of tax map key: (3) 8-I-007:Od5 and situated at (hiouli 2 and
Keopuka, South Kona, Hawaii. According, to Resolution No. 31-03 this condemnation action is
necessary as part of the development and construction of a Mamalahoa Highway Bypass behacen the
~ icinity of Keauhou and Captain Cook. Exhibits A & B tardier delineating the parcel are also attached to
Resolution 31-03.
During committee discussion. Assistant Corporation Counsel Gerald l~akase answered yucstiom about
the status of the Mamalahoa I lighway Bypass Project and the legaljustilication for holding an I[xcculivc
Session. Further discussion regarding this matter was conducted in Executi~ c Session.
Your Committee on Public Works and Intergovernmental Relations is in accordance wish the purpose and
intent of Resolution No. 31-03 and recommends it pass tn~st reading.
