Puna, Hawaii 'fMK: 1- 4-73: 3, reports as ti~llows: Bill No. 24 amends Section 25-8 ?2 (Puna District "Lone Map). Article K, Chapter 25 (Zoning Code) of the 1 lawai'i County Code, by changing the district classification for approximately 5.0006 acres of land from an Open (O) and Agricultural (A-la) to agricultural (A-Sa) zoned district. The semi-rectangular shaped subject property, owned in tee by the applicants, is located in the Vacationland Hawaii Subdivision, Unit li, on the east side ofllilani Road. approximately %z mile northeast of its intersection with Kapoho Beach Road. The property was acquired from Genoa Enterprises Company in March 2002. The subject parcel was created in 1963 as one of the 83 five-acre lots with the intent that it would be used for agricultural purposes. ~1'he Open designation was adopted in 1967 in conti~rmance with the newly-adopted State band Use Conservation District designation in 196x. l~he State band Use Boundaries lines Nerc drown using the Halekamahina land division as the dividing line without considering the subdivision. As a result, this and several other parcels were placed in the Open zoned district for consistency. In 1971, the State band Use Commission approved Vacationland Associates' request to amend the State Land Use Boundar}~ from Conservation to Agricultural, then considered to be a more appropriate land use. Duc to these boundary designations, the subject property was split between the State Land Use Agricultural designation and the Conservation designation, as were several other lots along the northern corner of the subdivision. The General Plan LUPAG map designates the area as Orchards. Approximately 1 .545 acres o1 the 5.006-acre subject property is zoned Open. which does not allow for the development of a residence on the property. l~he remainder of the subject property which lies along the southwestern corner is zoned Agricultural (A-1 a). "I~he applicants arc requesting the A-Sa designation in order to construct a farm dwelling, and to have one zoning designation instead of two. fhe Soil Conservation Service Soil Survey Report classifies the soils within the prgject site as Malama extremely stony muck, which consist of well-drained. thin. extremely stony organic soils Communication No. 58 Bill No. 24 Page 2 over A'a lava with rapid permeability, very slow runot~f~, and slight erosion hazard and is used for woodland, pasture and orchards. "Fhe Land Study Bureaus classitication is "F;" (Very Poor) for agricultural productivity. The AI,ISH classitication is "Other Important Agricultural I,ands'~. which includes lands other than Prime or Unique agricultural land. The subject property is located in Lone "X". an area determined to be outside the 500-year Hood plain. 1t lies in Lava Plow Hazard Zone 1. Two surrounding properties were rezoned to A-Sa and FA-2a respectively in 1991 and 1999. Immediately to the south and west are lots zoned Agricultural A-la. Further south are lots zoned RS-10. The Kapoho Beach Lots subdivision located to the southeast is zoned RS-10. Access to the subject properth will be from Ililani Road. Water is available through a County waterline which runs along Kapoho Beach Road. A septic tank system will be installed as part of the proposed development. l elephone and electrical scr~ices are available to the subject property. Bill No. 24, Draft 2, which includes the conditions inadvertently omitted in the original Planning Commission draft to the Council, was circulated and approved by Your Committee. Your Chair mentioned that this zoning is similar to another zoning, which was recently approved by the Council. Your Committee did not entertain further discussion on this measure. Your Committee concurs with the Planning Commission and the Planning Director for recommending a favorable consideration for the change of zone request, which would be consistent with the surrounding land use pattern already established within the subdivision. 'fhe Planning Commission also recommended that the applicants consult with the I Iistoric Preservation Division of the Department of Land and Natural Resources to verify that the property does not contain am~ archaeological, cultural or historic sites.
