Your Committee on Plamling, to which was referred Bill No. 26 transmitted jointly with Bill No.
25 by Mayor Harry Kim per Communication No. 59, dated December 19, 2002, regarding the
change of zone request by Karl and Rita Nobriga, at Manowai'opac Homesteads. North I lilo.

Bill No. 26 amends Section 25-8-19 (North Hilo District Zone Map). Article K, Chapter 35
(Zoning Code) of the Hawaii County Codc. by changing the district classification for
approximately 3.80 acres of land from an Agricultural (A-20a) to a Residential and Agricultural
(RA-la) zoned district.
The somewhat rectangular-shaped subject property. owned in fee by the applicants, is located in
Manowai`opae Homesteads on the south side of Hokumahoc Road, approximately 'h mile west
(mauka) of the Mamalahoa Highway. Originally part of a rectangular shaped parcel, Subdivision
No. 228, approved on December 12, 1949, removed a 10.000 square loot segment along
Hokumahoc Road, which resulted in the existing 3.80-acre parcel.
fhe applicant is seeking to subdivide the property into three one-acre lots. An existing d~~clling
constructed in 1975_ is located near the front portion of the parcel. Within two years, the
applicants propose to develop the two other lots for their sons. The undeveloped portion currently
is a goat pasture and location for a pigpen.
l~he State ).and Use designation is Agricultural. 'fhe Ll IPAG Map designation is l rban
Expansion, which allows a mix of high density. medium density, low density, industrial and/or
open designations in areas ~+~here new settlements may be desirable. but vv~hcre the spccilic
settlement pattern and mix of uses hove not yet been determined.
The project site is located N ithin the designed "Limits of Recommended Urban 1xpansion Area°
of the Laupahoehoe Rural Design Plan, which was adopted by the County Council in .Tune 1979
as Ordinance No. 444.
I'he project site is located outside the boundaries of il~c Northeast I lawai'i Community
Development Plan. which was adopted by the Counh~ Council in June 1979 as Ordinance
No. 445.
hhe project site is located within Subuine 1 of the Hamakuu Regional Plan, which was adopted
by the County Council on November R, 1990, as Resolution No. 244-90.

The property is not situated within the Special Management Area. It is located approximately
half a mile mauka of the coastline.
The adjacent properties makai, mauka and across HokGm5hoe Road are zoned A ?Oa and located
in the State's Agricultural District. One hundred forty feet makai of the property are parcels
zoned Single Family Residential (RS-IS) and also Village Commercial (CV-10) (towards
Mamalahoa Highway), and located within the State's Urban district A two-unit Condominium
Property Regime is located on an adjacent makai parcel.
The ALISH system designates the subject property as "Prime Agricultural Lands'. 'I~he Land
Study Bureau's Detailed Land Classification system designates the land as "C° or "Fair'.
The U.S. Soil Survey is classitied as Ookala silty clay loam_ with moderately rapid permeability.
medium runoff, and moderate erosion hazard, which is used for sugarcane.
The subject property is located in Zone °X'~, an area determined to be outside the SQO-year flood
plain.
Due to the cultivation of sugar cane and pasturage use, there are no known native fauna or Mora
or archaeological, cultural or historic sites on the subject property. A condition will be included
to require notification of the Deparumcnt of band and Natural Resources -Historic Preservation
Division, should any archaeological sites he encountered during the course of development.
Access to the subjcM property is from M<~malahoa I Iighway via Flokumahoc Road.
'the existing parcel does not have water service, however, water can be made available froth an
existing 6-inch waterline along H<~kumahoe Road.
Because the proposed lot is located within aNon-Critical Wastewater Disposal Area. cesspools
are allowed under the current rules.
All other utilities and services are or will be available to the subject property.
Bill No. 26, Draft Z, which includes the conditions inadvertently omitted in the original Planning
Commission draft to the Council, was circulated and approved by Your Committee.
Committee Member Robert Jacobson stated that he does not favor this project because the
subject property is considered prime agricultural lands and he does not want to break it down into
one-acre lots.

Committee Membec Fred Holschuh stated he is i^ favor of the intent of the subdivision because
housing is not readily available in the area, but will not permit any ohana development.
Your Chair stated that this measure conforms to the three planning documents for this area. She
also stated that the fair share condition shall be included in the next draft for the two additional
lots.
Committee Member Curtis 1 yler reiterated what Your Chair stated about the fair share condition
to ensure the applicants understood what was to be included. 11e also proposed an amendment to
Condition F, to include the words °and condominium property regimes."~
Your Committee did not entertain (ul-fher discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request, which would result in an
appropriate land use pariern that will further benefit the public.
Your Committee on Planning is in accord with the intent and purpose nt Bill No. 26. Uratt 2, as
amended to Bill No. 26, Draft 3, and recommends it pass first reading.
