Hawaii 96720 Your (bmmittee on Finance, to which was referred Bill No. 51. reports as Ibllows: Rill No. 51, transmitted by assistant Colporalion Counsel Gerald'fakase, via Communication No. 122, dated .lanuary 2~3, 2003. amends Chapter 2 of the Hawaii County Code 1983 (1995 I{dition). relating to administration. Rill No. > 1 proposes to allow the exchange of real property without public auction in order to sU'aighten roadway or to acyuirc encroaching right-of-way. "Phis measure also includes waiver of the appraisal requirement where the County wants to acquire private property when their roadways encroach into private propcrt~~ and whero the land will he exchanged for unused County right-of-way. 'This would eliminate situationv when the appraised report ~tiould create an unnecessary expense. During its discussion, Your Committee amended Section 2-I 15 (c) to include the tbllowing: (c) hhe real propert}' exchanged shall be of substantially equal value to that of pricatc land. Exccot as Otherwise provided for in subsection (d) below, in any exchange, the fair market value of the private land and the County-owned land shall be separately determined by a disinterested qualified appraiser or appraisers and the cost thereof shall he borne equall}~ hehvecn owner and the County.
