Your Committee on Public Works and Intergovernmental Relations, to which was reicrred
Communication No. 137 and attached Resolution No.40-03, reports as follows:
Communication No. 137 dated February 12, 2003, is From Gerald Takase, Assistant Corporation Counsel.
transmitting Resolution No. 40-03 for Council consideration.
The purpose of Resolution No. 40-03 is to authorize the abandonment and exchangelsale of road rights-ot=way
with Christian Sieber, Jacqueline Victorino, Caroline Victorino and Colleen Victorino, Tax Map Keys: (3)2-9-
004 (portion), 2-9-004:035, 058 and 092. According to Resolution No. 40-03. Kaiwiki Road, which is owned
and maintained by the County of Hawaii, has strayed from its mapped right-of-way. The current alignment of
this roadway traverses through privately owned parcels. The proposed abaadonment and exchanges of
property between the County and the above stated individuals is aimed at addressing this present situation. A
reap attached to Resolution No. 40-03 specifically identifies the live remnants that are a part of this action.
At today~s meeting, Gerald Takase. Assistant Corporation Counsel, provided this committee with a brief
commenta-y about the origins and purpose of Resolution No. 40-03. In addition, Attorney Michael Moorc
answered questions about the details of this transaction on behalf of his client Christian Sieber. "To clarify the
extent of the County's role in this arrangement, this committee has requested that copies ofthe agreement
between Mr. Sieher and the Victorino's be forwarded to this body before the next scheduled Council meeting.
Councilmember Tyler voted kanalua times two.
Your Committee is in accordance with the purpose and intent of Resolution No. 40-03 and recommends its
adoption.
