Your Committee on Finance, to which was referred Resolution No. 43-03, reports as follows:
Resolution No. 43-03, transmitted jointly with Bill No. 61 by Director of Finance
William Takaba, via Communication No. 149, dated February 20, 2003. authorizes the Ofticc of
the Mayor to enter into an agreement with the Stale of Hawaii Department of Defense, State
Civil Defense for the Citizen Corps Council and Community Emergency Response Team
Programs grant.
The State of Hawaii Department of Defense, State Civil Defense has authorized a $31.632 grant
to the Hawaii County Civil Defense Agency for the formation o1'a local Citizen Corps Council
(CCC), and to develop, form or expand the Community Emergency Response 'Team (CER'f)
training program. These State funds are derived from a grant provided by the Federal
Emergency Management Agency (PEMA) and arc to assist in preparing for potential
consequences of a terrorist incident or threat in the State of Hawai' i.
Pursuant to Section 46-7, Hawaii Revised Statutes. county departments must obtain the consent
of the council to enter into agreements with the federal or state governments respecting action to
be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds
or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
Some Members of Your Committee expressed concerns over the fact that the Mayor signed the
agreement before obtaining the council's consent as stated in Hawaii Revised Statutes.
Section 46-7.
Your Committee on Finance is in accord with the purpose and intent of Resolution No. 43-03
and recommends its adoption.
