Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 44-03, reports as follows: Resolution No. 4403, transmitted jointly with Bill No. 62 by Director of Finance William Takaba, via Communication No. I50, dated February 20, 2003, authorizes the Office of the Mayor to enter into an agreemem with the State of Hawaii Department of Defense, State Civil Defense for the FY 2002 State Domestic P.quipment Program grant. The State of Hawaii Department of Defense, State Civil Defense has authorized its FY2002 State Domestic Equipment Program grant funds of$591,051 for the Hawaii County Civil Defense Domestic Equipment Program. This funding is the third increment, which the County has received as part of its Domestic Equipment Program that began in 2001. These State funds are derived from a grant provided by the Department of Justice, Off ice of State and Local Domestic Preparedness Support, to mitigate the consequences of a weapons of mass destruction threat to the State of Hawaii. The purpose is to ensure first responders are properly equipped and prepared to respond to incidents of domestic terrorism involving chemical and biological agents, as well as radiological and explosive devices. The Hawaii County Police and Fire Departments will be using these funds to acquire specialized trst responder's basic defensive equipment. Pursuant to Section 46-7, Hawaii Revised Statutes, county departments must obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. Some Members of Your Committee expressed concerns over the fact that the Mayor signed the agreement befbrc obtaining the council's consent as stated in I lawai'i Revised Statutes, Section 46-7. Your Committee on Finance is in accord with the propose and intent of Resolution No. 44-03 and recommends its adoption. smc All?S NO4a A&4.
