Your Committee on Public N orks and Intergovernmental Relations, to which waa referred Cunnnunication
Nu. 221 and Resolution No. 65-03, reports a, follows:
Communication No. 224 is fium Council Member Gary Safarik dated April 23. 2001. u<msmitting the
above resolution Ibr Council consideration.
The purpose of Kesolution No. 65-03 is to urge the Mayor and the Department of Puhlic Works to initiate
[he immediate renewal of a gate located on county roadway property along the Puna Emergency Access
Road (PEAR). The resolution was co-introduced by Council members Gar}~ Safarik and Bob.lacubson.
According to Resolution Nu. 65-03, the Public Works DeparUnenl discovered that a gate Mocking access hi
Pl?AR that was installed in May 2002 by the Ainaloa Community Association is on Counh properh.
I~urther, the resolution report. that the proper authority to close a Counh roadway is the Hawaii Cuunt~
Council who has not approved the road closure. l'he resolution resolves that the Mawr and Public Works
Department work with the Ainaloa Community Association Io remove the gate fiom public property by

4t today's meeting. Council member Gan Safarik provided a chronological hisnu~y ofe~ents oflhe Puna
I?mergency Access Road project. He also infbrnred members that since the introduction of Rewlution
No. 65-03 circumstances had changed. First. the Ainaloa Conununity Association had relocated the eatc
t}om County property onto Ainaloa Comnnmity Association property. Secondly_ the Public Work
Department had installed their own gate on the County parcel and secured it. Mucking the road. without
Council approval. l~hese recent events prompted a second draft of Resolution Nu. 65-U 3. urging the
removal of the gate not authorized h} the County Council. The committce further amended This second
draft with language allowing the gate to remain, but in the open position.
