Your Committee on Planning, to which was referred Bill No. 72 transmitted jointly with Bill
No.71 by Mayor Harry Kim per Communication No. 168, dated March 3. 2003, regarding the
change of zone request by Erwin L. Baldwin, at Ouli. South Kohala. Hawaii TMK: 6-?-9: 9,
reports as follows:
Bill No. 72 amends Section 35-8-7 (North and South Kohala District Lune Mop). Article 8.
Chapter 25 (Coning Code) of the Hawaii County Code, by changing the district classification for
approximately 6.104 acres of land from an Agricultural (A-Sa) to a Residential and Agricultural
(RA-2a) zoned district.
7'he rectangular-shaped subject property, owned in fee by the Erwin L. Baldwin Living ~-rust. is
located in the Kanehoa Subdivision hordered by Kawaihae Road and Ouli Street. l~he property
was previously used for cattle grazing and is currently vacant of any uses.
1'he applicant proposes to subdivide the property into two lots. 3.837 acres and 2.267 acres in size.
I~he applicant resides in the existing dwelling located nn the proposed 3.837 acre lot.
The LUPAO map designation is I?xicnsive Agricultural. which allows uses Cor pasturage and range
lands. In 1967. with the adoption of theL.oning Code, the property and surrounding areas were
zoned Unplanned, where no sufficient studies were conducted to adopt specific district
classification. When the 7,oning Code was adopted in 1996, all Unplanned zoned districts were
reclassified to Agricultural - 5 acres. Under the proposed State Land l Ise Rural District and RA-2a
zoning, ohana dwellings are permissible.
The property is not located within the Special Management Area. as it lies approximald} 7 miles
from the nearest coastline.
I~he 26-lot Kanehoa Subdivision. created on April 29. 1985, currenth consists of 2R parcels. The
Planning Department records indicate Ohana Dwelling Permits were approved on 16 lots within
the subdivision, and Tax Department records indicate there are 14 lots with CPRs.
l~hc 36-lot Anekona t~states Subdivision, created on October 23, 1990. presently consists of 47
parcels. ~fhe Planning Department records indicate Ohana Dwelling Permits were approved (i>r 12
lots within the subdivision. and 'fax Department records indicate there arc 14 lots withCPRs.
The adjacent parcel to the south has recently been designated as Rural and Residential-
Agricultural. Parcels to the west and cast are still designated as Agricultural. and arc used for

residential purposes or are currently vacant.
Surrounding lands are located within the State's Agricultural and Rw~al Districts and the County's
n-Sa and RA-2a zoned districts. In addition to the above, the ten-lot Kamuela Plantations
Subdivision lies immediately east of Kanehoa Subdivision: the Anekona [?states Subdivision lies
immediately west of the Kanehoa Subdivision: and the 26-lot Waimeu Landmark -?states
Subdivision lies across Kawaihac Road and further westward. These subdivisions include mixed
residential uses, vacant lands and very few residential/agricultural uses. 'I~he 33-unitOuli I~:kahi
affordable rental housing project and the 40-lot Ouli Mutual Self Help I lousing subdivision are
located to the west ofAnekona 1{states Subdivision. The Hale Wailani Subdivision. located west
of Anekona Estates and adjacent to the housing projects is currently zoned A-la and the developer
proposes a 49-lot subdivision consisting of lots with a minimum size of two acres.
The subject property and the surrounding area arc "Unclassified' on the ALISH map. Soils within
the property are classified as "F.° or "Very Poor" for agricultural productivity. The U.S. soil
Survey classifies the soils as Puu Pa extremely stony very line sand loam with moderately rapid
permeability. medium runoff and moderate erosion hazard. which arc used fbr pasture.
The property is located within Zone X. an area determined to be outside the 500-year flood plain.
(here are no known or recorded rare or endangered animal or plant life in the area. Because the
property was previously graded and grazed by cattle, no known archaeological, cultural or historic
sites arc on the property. however, should any archaeological sites he encountered during the
course of development. a condition will be included to require notilicaiion of the DLNR.
Access to the subject property will he from the Kawaihac Road via Ouli Street. Sixteen parcels in
this section of Kanehoa Subdivision have access to Kawaihac Road cia Ouli Street. and twelve
parcels have access via Kanehoa Street Ouli Street is a private road with a 50-toot right-ot=way
and a 20-foot agricultural standard asphalt pavement with grass/gravel shoulders.
Water is available through iwo service latm~als with a 5/8-inch meter.
Wastewater will be disposed of through a septic tank system which meets the approval of the State
Department of Health.
All other utilities and services are or will he available to the subject property.
Your Committee did not entertain further discussion on this measure.
Your Committee concurs with the Planning Commission and the Planning Director for
recommending a favorable consideration for the change of zone request, which will result in an
appropriate land use pattcm that will further benetit the public.
Your Committee on Planning is in accord with the intent and purpose of Bill No. 72. and
Communication 168
